Hi all. Just to update what happened. Sure enough, this morning, before we went in to see the judge, the insurance company offered us what we were asking for all along. The medical is being kept open, they are paying the wages due for the 3 months hubby was out of work, and they are paying for the lawyer and dr's testimony-if they hadnt denied us in the first place, there wouldnt be lawyer fees and fees for the drs testimony.
I am so glad this is over for now. I know they are going to be terminating him in the near future-if they dont already have a reason, they will find one. I know this is an at will state-but it seems like just terminating him isnt enough-they have to rip him apart first. Thanks all again for all of your advice. I will add more if anything comes up in the future-which Im sure it will...LOL. For now, we can rest a little bit easier. |

i'm so glad this worked out for ya'll...........
i will keep hubby in my prayers that he will recover from his injuries and get some quality of life back............... you didn't say (or i don't remember) what type of job hubby did but i'll also keep him in my prayers that if he has to leave his current hosp he'll soon find an even better job....................you know if they're going to make his life miserable he'll probably be better off at another place but i know it means giving up tenure, benefits such as amt of vacation time accrued and insurance for himself and the family and it's just a downright shame that thru no fault of his own he'll have to face that............... nurse83 "After all, tomorrow is another day." Boy, talk about pain. Imagine how much it's going to hurt that insurer to reach their pocket. They really had their heart set on keeping everything.

Its not so much the vacation time etc. that has been accrued, its that I think finding a job in what he does will be very difficult at this time. (I dont want to be too specific-I dont know who is reading these boards). The medical insurance worries me- we won't be able to afford cobra for our family if he does lose his job. |

In all seriousness though-Ya know-we ARE very thankful that it worked out this way-and I dont want to sound like Im not thankful-but....for the 3 months he was out of work, we lived off our credit cards. I paid my mortgage with savings we had set aside. with interest, and the difference between hubbys salary and what comp does pay, we are still short on that cc bill-even once I use the whole check to pay it off-and with the prospect of him losing his job shortly, I dont know how we are going to crawl out of the hole. I guess what I am trying to say is (I know-I am preaching to the choir-so many here have been through hundreds of times worse then what we have been through) he got hurt through no fault of his own-I mean who would expect a puddle of water on a floor in a hospital right near a supply closet, our lives were turned upside down, besides worrying sick about dh's health, and watching him dealing with the affects of medications he isnt used to taking-having to explain to my 4 and 5 year olds why daddy is "cranky"-and on top of it-having dh's employers treat him like a liar-and not one person from his department even called him to see how he was feeling the whole time he was out-I just cant help but feel so bitter about the way things work. He wasnt asking for anything he wasnt entitled to-actually at one point I was begging the nasty woman from the insurance company to reconsider her decision as she very smugly with a definate smile in her voice-rudely told me-"I have decided to deny this claim because I think your husband had prior problems, and since no one saw him fall-frankly I just dont think it happened the way he said it did" before we hired the lawyer....How do they have the audacity to have one very nasty woman singlehandedly deciding our fate??? I have to admit, I was very nervous about the attorney we hired (some of that has to do with the fact that this is only the second lawyer Ive dealt with in my life-the first being the attorney who handled my very nasty divorce from my first husband-where I was very royally screwed (only to find out that he specialized in estate law-not divorces)....But I truly believe if not for him, we would be sitting and waiting for a year or more for the 3 months pay and the medical to be paid.... Im sorry-this wasnt supposed to be a vent-I should be thrilled right now-its just that it still isnt over for us-hubby is still dealing with the pain on a daily basis-even though its not horrible pain-it is still there always and every time I see him wince it makes me sick-and I have to sit there and watch him suffer in addition to worry about whats going to happen when they finally hand him that pink slip. |

well now that you seem to have deleted your personal financial resources maybe it's time you planned for the worst while hoping for the best of course and find out what resources may be available to you should hubby be terminated............most, if not, everyone on these boards was accustomed to working hard and providing for themselves/families and never thought about such things but at times like these any one of us who is in need of and eligible for assistance should take advantage of it...........
state, federal, local churches and organizations such as food banks...look into all avenues..............especially with little ones like you have please! i'm sure you've already cut back where you could but go ahead and figure out how to splurge on the luxuries like food clothing heat and shelter ![]() LOL................a sense of humor really helps; at least it does me; otherwise i'd be sitting in a corner sucking my thumb.................you are among friends here; always feel free to express what you need to check the off topic threads; but they really should have a warning label because some of those posts will have you ROFL nurse83 "After all, tomorrow is another day."
