I could not be a WC adj

I was an employee driving for a company. I worked overtime sometimes 12 days straight. I was injured in a work related auto accident. The other driver hit me head on and was at fault. NO FAULT OF MINE

Received a call from third party insurance which told me to have all bill forwarded to them

When adj called she was so rude , unsympathetic. I told her I do not want to file a claim.

Next day HR called and said they would only be able to hold my job for 2 weeks if I didn't file WC.

I loved my job...I hated sit down jobs and was very active. So, I decided to go WC...what a mistake. They terminated me anyways..saying I was unable to return back to work. Which was a lie, I was working counter making the sales quote and not receiving sales commissions because I was still considered a driver...nonsense.





I went back to work on light duty but still in pain. I obviously couldn't drive due to the pain meds but my employer insisted that I did.

After 6 times out in the truck I decided "this is wrong " they can not force me to break the law and make drive while on pain medicine.

I called local police and asked if this was legal,they said no.
I would be at fault and responsible if I would be in an accident.
The police refuse to drive and report it to us the next time it happens.

So they finally got the WC doc to send me back at full time and released me from care.

Now I told the DM that I was not healed and needed more care he said...nope..wc doc released you

forced to take 12 leave and now terminated because I am still waiting for the hearing 3-7-08.

When I was on light duty they had me on the counter which I performed
as well if not better than others.

We were hiring for counter people not drivers.

I think this was all done because back in 3-07 I received a raise that never happened. Went to DM he said he didn't remember me getting a raise...( he was present with the manager)

I finally in Aug of 07 went over his head to get my raise..RM said he would check into it and next paycheck I received my raise and what was owed from 3-7.

So 3 days later I was told I had to go back to driving from the DM, knowing I couldn't. The DM was apparently reprimanded.

I have read some of the post from owners of business's. To bad companies couldn't be like some of the owner on this forum.

A message to you. Not all WC cases are bogus. I have been sitting at home on pain pills and without a paycheck. I much rather would of been going to work and making a living.


I am seriously hurt....so before you fire an employee for a work related injury...make sure you have addressed all possibilities that the employee just might be telling the truth
