Yes, be very careful about closing out your medical as well as taking the first offer they throw at you. I know that 1 level fusion cost me 80,000.00, and my Surgeon warned me that once you have 1 fusion, it is common to end up with oher fusions down the line. I have already had 2 and hope that is all, but don't settle without medical cause you just don't know.

When my WC adjuster finally admitted My injury wasn`t preexisting she want to talk settlement instead of surgery. The docs said sooner or later and I opted for sooner.

I Agree with Jayne and the Others 100%!!! You should NEVER Settle if You are not Healed the Best You can Be, Period!! Please Walk with Caution, and I Surely Hope Your Attorney guides You down the Right Path! Many Times Attorneys and i/c's want to Take the Easy Way Out, and it's up to Us to Make Sure Our Rights are Protected!! Read as Much as You can about Your Rights and the Laws in Your State, and be Educated when You Speak to Your Attorney! This May not Make Sense now, but it Will at Some Time while You are Dealing with w/c, Attorneys, and so forth: "Never Ask a Question You don't Already have the Answer For!!" That way You will Quickly know Who You can Trust!! Best of Luck, and I Hope All Goes Well!!!

there are many situations where a buyout is a better option then continuing the conflict and litigation; each worker's circumstance is different and it would not be foolish to consider a settlement in some cases.

My state WCB will not allow settlement without open medical in the case of uncontested causation. I wouldn't settle without open medical either. That's just crazy. But then again sometimes you don't have a choice.

My doctor told me right at my PIR rating that my medical is left open. This is just a lump sum award for my injury as you cannot claim pain or suffering and that is how they do it here in NH. I would NEVER ever close my medical, as just today i could barely even put my belt on my pants and was in tears as i headed to the pain clinic and told them i need to get fixed. I know there is a doctor out there somewhere that maybe able to help me. I will get this wc settled as they are paying within a week or two the adjuster said , and then i will get my primary to help me from there.
