Reached MMI today
This is my first time here. My husband was injured in 09/2006 when a 3000lb boring rig flipped on top of him. It crushed all the soft tissue in both of his legs, snapped his femur in half, soft tissue damage to his shoulder, and he has moderate hearing loss in both ears. We visited the doctor today because he was having a terrible time w/ swelling and numbness. Dr. told us that he was at MMI and that he really needs to start talking to his employer or other employers about another career path that would be using his brain and not his body. We are in NC. We had no idea that this was coming. His WC nurse told us that she would get us in touch w/ a vocational rehab specialist. Does this mean he is "possibly" disabled?

Hi Skippy, welcome to the forum and I'm sorry to hear your husband and yourself are going through this. I think we need more info sweetie. What kind of treatment has been done, physical limitations, etc if you can. I know this is hard to go through but the more info we have the better we can help you.

I agree with Sithie, I would start searching for a good attorney and I mean a good one. Don't take the first one that comes along. Interview them and try to figure out how good they are in their field. My lawyer sucks and YES it makes a huge difference believe me.

Welcome to the forum. It sounds like your husband has had a terrible injury. When the doctor said that your husband was at MMI did he happen to mention what kind of employment he thought that he could do? You said that the nurse said that she was going to contact a vocational rehab specialist? Is this service going to be paid through the W/C IC?

I agree with the others you need a lawyer and now. Find one that is certified in workmans compensation. They are educated and experienced in laws surrounding workman's compensation. Every state is different in its approach toward workmans compensation. Best of luck. Keep us updated.

Hi,
Seems to me if your husband is still having to go to the doctor for medical issues related to his work injury...that he wasn't ready to be put at MMI! I assume the doctor that put him at MMI was hired by IC.
You need another medical opinion I feel. Get a lawyer as the others have advised, and do it Pronto.

First I would like to agree with monster about searching for an attorney and finding the right one. Two things to keep in mind with your search is to pay attention to the initial response from the attorney your getting the free consult from...is he nodding and saying no problem? That is not a good sign...you want someone who is going to say this is where your at and this is where we need to go from here. Also, remember yoor hiring the attorney to work for YOU and therefore should get the services you are paying for...do not be afraid to demand this from your attorney.

Also, MMI does not mean your hubby needs no more medical care...it means he will in all liklihood not improve much more. The doctor has to determine when he has done what he can to bring about improvements to his patient. Can a doc be wrong on MMI? You bet. A doctor is human and can not anticipate recovery later on. I improved after MMI quite a bit, so do not lose hope.
