So they did a PIR ( permanent impairment rating?) and you did not reach MMI yet? From what i was told you need to be at MMI before a rating is done. I just had mine cause i was at MMI. They have me down as Carpal tunnel recurrance and upper extremity neuropathy. I do not know what my rating is yet and should hear anytime. Was the 50,000 offer for medical also? Because i was told that my medical is to be left open from my occ. doc that preformed my rating. Did they do any surgery yet for your carpal or are they still in dispute of it not happening while working?

I suggest you get on your lawyer for a second opinion or get a new lawyer....if you are not fixed as well as they can fix you then you are not at MMI.However you may be MMI for that Doc and not for another......
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

While I cant answer your questions because I myself am still kinda new to this I can confirm your" holding the steering wheel ". During my wreck in a rig I held the wheels when I t-boned a dump truck and after beeing but asleep for 4 days I woke to discover my arms swelled as big as my legs from the impact.

Thanks to all for your words of advice. I have already emailed the lawyer asking for a second opinion. The hearing is probably this month, so I need a second opinion pronto. |

First of all is your attorney one who specializes in work comp only? If not, you need a new attorney. I would think that he should have sent you to a doctor to determine and verify that your injuries are indeed from your work. Have you had any medical treatment at all? shots, meds, epidural injections, etc.....??? If not then I do not see how you possibly could be at MMI. I have bilateral carpal tunnel, failed surgery on one, told not to have it redone or done on the other hand. I have bulging discs also, the worlst being the L4-5 S1 with a tear. I have the sciatic pain, both hips and legs, worst on the left, due to nerve pressing on the thecal sac, also in my tailbone. I was told surgery would not help, probably make me worse. I had the epidurals, worked for a couple of months, then got worse. I have just settled my case, six figure, and they are paying for 2 years of my medical insurance. Thus I am out of the wc system, and glad of it. I go to my own doctor for spinal and cervical adjustments, which help me for a couple of months at a time. I take vicaden, desipramine, and effexor for depression. will for the rest of my life probably, Get on your attorneys BOBO, and if he isnt wc certified, find a new one that is! My opinion only. wishes for a pain-free day! annoyed |

If an insurer offers any money to settle a claim, it is because they know they have some liability. 50k is an unusually high offer, so it seems they might want to get rid of you fast for some reason. I would never settle based on the opinion of any one doctor, and would be disappointed with an attorney who would expect you to. Did anything happen to your head in the accident, did you have headache, dizziness, blurred vision etc?
