RE: MMI 5% - Hearing for medical need help
Thank you trucker for your reply. You are definitly no where near MMI. You still have so much more testing you need to do instead of them wiping their hands of you. Fight to get more testing done to find out why you are having all these problems. As far as the PM doctor, i hope you got rid of her. PM is to help you deal with your pain, and seems this woman has no concern for what you are feeling.

Definitly talk with your lawyer and push to get a doctor that specialises in the field of your injuries. I wish you the best. You are a long way from getting healed and should nowhere be put at the end point.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%

Thanks for your advice. Will talk to atty today. How are you doing?

RE: MMI 5% - Hearing for medical need help
I also had a lot of problems which I didn't feel were properly explained. 3 years after my injury, I was finally diagnosed with a mild traumatic brain injury.
The delay in being diagnosed did not help my case (they said I probably got it someplace else after the accident and it wasn't their responsibility)
At least I know what's wrong and have been able to receive proper care which has helped me.
If there are discrepancies, between your first and second opinions, if the original doctor missed something, you may have some options. What state are you in?

RE: MMI 5% - Hearing for medical need help
I'm not quite sure what it is you are asking. Is this an informal hearing, a formal, or what? What medical treatment are you looking for? Pain management? Treatment for the Carpal tunnel?

I am happy to give you the benefit of my opinion but I'm just not clear on your situation. You say you have a lawyer. If you trust him or her with your case, and you have these questions, you should call and ask him. If he is a good lawyer, he will be able to answer all of your questions and ease what seems to be considerable confusion.

Good luck.

Jim

hurt trucker Wrote:Good evening. I hope everyone is enjoying their New Year's Eve. My wife is typing this for me. I have carpal tunnel and cannot type. I am in lots of pain with falling. I still use a quad cane to walk.

I was given a MMI of 5% for my neck and back (bulging disks in my neck and thoracic). They say that this is NOT CAUSING MY PAIN. WC doctor says it is not related to my accident. Nerve damage L5 in left leg and am falling. Carpal tunnel in both hands. In the beginning, WC doctor said that the carpal tunnel was caused by the strong hold I had on the steering wheel during the accident. Underlying I believe she stated. Nothing bothered me until the accident, no neck or back problems, no problems with my hands and no falls. Before the accident, I worked 12 plus hours a day, hard labor and was ready for more. They are thinking some of this might be related to arthritis. Funny how everything went to sh@% the day of the accident.

My atty says we will have a hearing in Jan to get my medical treatment paid for by WC or at least try for it. They say the WC doctor (pain management) will be in the deposition and will have to testify that none of my problems are related to the accident. She has given conflicting statements and I hope that things will turn around for me. I cannot believe that I could get screwed and be SOL just based on her.

What are your thoughts? The atty says my weekly checks will continue for a while and they get every 4th check now. The insurance co wanted to settle for $50K and I am in NO SHAPE TO SETTLE YET.

Thanks for any words of wisdom or advice. What should I expect in this hearing?

Thanks again!

RE: MMI 5% - Hearing for medical need help
Thank you trucker for asking how i am doing. I am having alot of trouble this week with dealing with my pain. Seems it is getting worse. I am having so much trouble with the shoulder area and continues all the way down to my fingertips. I can feel pain on the same side right under my ear on the side of my neck. I have been going to pm once a month to check in and get my meds refilled. I told the doc i do not want to increase my meds at all as i am on some pretty heavy stuff and do not want to get to addicted. Seems i have had to take more medicine than usual to get rid of this pain this week more than ever. I am just thankful i have something for this time of need.

I hope it is only the weather as it is very cold here, and just wish it would ease up on me a bit. I need to slow down at work, and seems like everything i touch lately, ( toilet paper, paper towels, hand cream, ketchup bottles etc. ) lol all need to be opened.

It is my dominant hand that hurts and just playing around trying to open these alot more than usual this past week may be causing it. Even putting on my belt has been a real task this week. I just wish i could get the help i need to get myself taken care of to try to be SOMEWHAT normal someday.

Still waiting on the rateing, and have a appt. with my primary doc the 10th. I was hopeing that i will hear the rateing before i go, so that i can get a MRI ordered and pay for it myself to see what is going on, and if i can get repaired. Thank you for asking..LOL I feel much better venting.

RE: MMI 5% - Hearing for medical need help
Hurt Trucker, I seen you wrote the word (depostion). In many cases, that should be performed before a hearing. ( But Anyway) And it's only my Opinion, I just don't like Pain Management Doctor's. Too me, from all I have heard here, and from what I seen on my own, these type Doctor's in my book being rated Good to Great is been averaged only in my book as 1 in every 1,000. There are some here at the board, that can say they have a great one. Like I said my opinion.

Hurt Trucker, I relive my injuries every day, and almost every night. The flashbacks are endless. This is something no Attorney, Doctor, Hearing Officer, or Insurance Carrier, can remove from my brain. or anyone elses.

If I put a picture of a skeleton up here, that was in your position at time of Injury (Impact), you would surely see what your arms are connected too. It is then when the Rocket Science gets removed. Then if we cover that skeleton with the Bodies Muscles, you would surely see what they connect too, how they connect to each other, and also what they protect with their covering.

It becomes a point in a persons best interest, to become best friends with their Attorney. Then get out, to see a Independent neurosurgeon for the Spine. And a Independent Hand Specialist for the Carpal Tunnel.

As stated by Harvard about Carpal Tunnel (web site provided below)

(Note) Injured workers, it is coming very close to Carpal Tunnel being removed as an Injury due to Typing on a KeyBoard, So beware now) {For the word is out on the streets this year} 2008....

{provided by 1171 sometime ago.... } but, soon to become new Law...

Hurt Trucker; The Human Body, at time and point of Impact; Now there's your question; You get someone to answer that for you, as what was the amount of force starting at your hands connected to the sterring wheel, then at your forearm, upper arm and shoulder, then your spinal Vertebre's, and you just removed what is Rocket Science to Pure Medical Facts of Impact to your Body. {Note} isn't that why they use Crash Dummy's??? If you need to think about that twice, you may have your needed answer. You should know, the NHSA should help or might be able to help, to provide the Math for you... (HINT) {Hint} Or get your Attorney, to request the information from the IC's Attorney at your Hearing, and also from this so called Pain Doctor. Watch the eye's light up then... Watch the light bulbs come on...

I one time, had removed a Steering Wheel that became bent, when a Co-worker has hit by a car that jumped lanes on them, which then caused a head on collision. So, give this some thought.
