I am sorry I guess i read your post wrong. You can get w/c and ssdi, but with either of those you can't collect unemployment or state disability. With w/c and ssdi You will only get up to your limit for your state because ssdi will be offset by your w/c benifits. If you are presentlly getting unemployment and your doctor says you will no longer be able to work then you really should apply for ssdi, but if you are going to be disabled less then a year you will have to apply for state. Now what you can do is apply for state now and if your doctor will back you on the fact you "can't" work anymore then you can apply for ssdi.

One more thing if you are applying for disability you need to do so asap because in ca, you benifits are based on how much you have made in the past year on average.

I ask what is the chance of a person hitting this website, as they click into Channel 2 News to report a WC issue?
I am a Special Needs teacher who had the PCL kicked out of her knee, in a self-contained classroom. If I am tough enough to take the pain... Why the hell can't the school support and pay for my new knee, with a huge scar all the way down my leg?
It's been three years my career is over ,with a $50,000 Master's to pay off. OH! The games they play, is there a attorney in this world you can trust?
I have been told that pretty Ron B. has a lot to do with us in Chicago not being able to get help!

I only read page 1 of this thread as my computer wouldn't load up page 2 correctly. But if I reead right someone was asking about drawing unemployment and filing for SSDI. Well I tried this and my attorney ALLSUP scolded me BIG TIME. As they put it if you draw you are telling the Government you are able and willing to work if it becomes available. Well I couldn't work, barely walk after all of the knee surgeries I have had. I just listed places and knew I wouldn't get hired. I had close to 1 year's money out there. I hated to lose it. so i used it for around 6 months and then quit. So be careful as when I go to my hearing in June I am sure this will be brought up. Good Luck!!

We share much of the same story.

I worked as an Early Childhood Teachering a was caring for a child with a medical condition in my classroom when I was injured.

I was injured in 2005, both knees. I continued working in the classroom after my injury and was not sent to a doctor until 2 months later.

I had my first of 3 knee surgeries 5 months after the injury. The last surgery was a total knee replacement, it took 31 months for approval of this surgery.

The insurance company for the school I worked for has been fighting me over treatment since day 1, and I worked for this school for 10 years previous to my injury.

I do hope your recovery and treatment goes well.
