I am so happy for you!! I know what you must have felt when you reached an agreement and signed those papers!! I felt so relieved that I slep for about 18 hours straight and when I woke up, I felt as if a great big weight had been lifted!!! I know you did what was right for you and your family, and for that...I'm happy for you!!I know also that some people will say to themselves, and maybe even out loud, that they would have done this or that differently, but really....when it's all said and done, we have to do what is right for US....not everyone else!! Congratulations, I know this is long overdue!! May you find some peace now knowing that this ogre is off your back!!! Punk  :0) "If I were any better....I'd only be half as good as you!!" |

Wink i have one question. How do they contact you for a settlement agreement? By mail they make a offer? I just had my PIR rating on the 7th and told it could take no longer than 15 days to hear from the ic. If for some reason they come back with a small settlement, i will have to fight and get a lawyer. They know i do not have one, and that troubles me already.
Just how long before you heard of your offer after your rating? Every bit will help me right now. My doctor that did the rating, alrady told me that my medical is to stay automatically open. That he put in the notes and told me that would not change. Now i just need to wait to see what they will offer. Hopefully it is soon, so if i need to pay another doctor to do a PIR i will have plenty of time. There is a standard 15 day wai i think till they offer. Howl long did yours take? Sparkey, My case was different than most, for many reasons, and I was never offered anything. In fact, minutes before my hearing the IC's lawyer told my attorney he wasn't offering anything. I'm certain that arrogant *** wishes now that he had. The below link just about sums it all up. As for the rating: I was given a 10% rating by one doctor and 13% by my own. However, he included in his notes that that was the only rating he could give per ama guidelines without surgery, and that he felt the rating was not truly representative of my actual disability and that he would leave it up to the commissioner to decide. Fortunately when my hearing was held the commissioners viewed my case subjectively. Since then, the WC laws in SC have been revamped and it is my understanding that the commissioners are no longer allowed to be subjective. Sparkey, of course the IC is going to lowball you. I would suggest getting a lawyer. I swear to God, a co-worker friend of mine had the same injuries as I. All he got was a $10,000. He had no lawyer. I will be receiving a 6 figure sum, plus future medical. I had a sharp lawyer. See? There are a few others on this forum who have like-stories to tell. Thank you so much wink, and congrats on your settleing. I am sure they are only going to come back with about 10,000, but then i go to a lawyer if i do not agree. It is such a shame that one person has to hire a lawyer to get what they rightfully deserve. I am hopeing that they do not offer such a settlement like that to make me fight in court. Things have sofar gone smoothly. I have a feeling it will be a fight for sure. Thank you again for the info.
