I am so happy that you want to ban together. I am not a victim but my
son is. Him being bipolar add/adhd dyslesic makes him already handicapped. We've tried the newpaper here but not interested. Tried to contact the governor just brushed off to lady in ombondsum here. Then my husband told me people don't want to get into this because they have employers that pay for worker comp insurance. Makes sense to me. I've tried the ACLU but they were "too busy" But I bet you if injured victim from all different states banned together they might reconsider. Go to UTube and in the search box put in "workers compensation" or "injured workers" you will be amazed at what is going on in California. I am in Virginia and we should note what state we represent. This is an election year and health care is an important issue. Even if the candidates don't care they just might listen if they think they will get a vote. |

Jayne is correct. Not a perfect system, far from it, but it works for many. The invisible injuries, the life altering, permanent injuries, the ones with the greatest exposure and expense for the insurer are the ones that get down and dirty.

I have been waiting to fight alongside other injured workers. I was hurt on the job over a year ago. My MRI confirms a disc injury won't go into more details unless someone really wants to hear. Because of it I have been put on TTD and the depression due to the physical, emotional pain is so hard to deal with. I enjoyed working and it has all been taken away. My husband has been laid off, so financially it is really tight especially since I still have 2 of the 4 kids we adopted and my grandson living with me. We have no medical benefit and cannot take the medication I was on before due to the cost (forget medical I cannot stand in line for long). My doctor has put in request for mental treatment as he does not believe I will heal properly knowing that my life will be forever different because of this injury. I went through 2 depositions and was totally embarrassed by the questions and subjects that were brought up which had nothing to do with my present injury. I am in constant pain, sad, and angry because my injury came from going above and beyond my line of duty, however, I am now treated as a liar, opportunist etc.... I also believe that lawyers are very limited because of the low amount they get from our cases and their overload. So, there is nothing better that I would like to see than fair, just treatment for all of us injured workers. Let me know how I can participate and I will do what I can physically do. I am in California, please contact me and help me I am truly going crazy!

This System is Very frustrating, I Know I have been at it for Over 3 years, and I'm totally Disabled from My Injuries! It's a Sad truth, but One I need to Address: Jayne is Absolutely Correct! Please Read the Thread on Page 2 Here, Entitled the Same as this One, to get a Few Other Responses! Banding Together Sounds Great, until You find How Complicated it's going to get Real Fast!! And until You have Raised enough Money to have More than the i/c's Pay Our Lobbyists and Representatives so that You can Buy a Few as they Have, it's going to be a Tough Battle as a Group! I Posted My Thoughts on how to Win One Case at a Time on the Thread on Page 2, and Jayne and Others have Excellent Advice there Also! You are to be Commended to want to Stand Up and Fight and be Heard, But Please Keep this Thought while You are Rallying for Battle: w/c has been Proven to Follow the Golden Rule, as They See it- THE PERSON WITH THE MOST GOLD MAKES THE RULES!!! So, My Opinion Only: Your First Line of Defense is to Raise the Funds Necessary to Buy the Politicians, The IME Dr.'s, and the Shady Attorneys the i/c's Retain! Best of Luck in Your Battle, I Hope you Can Make a Difference, It's not going to Help Me, but it May Help Others in the Future. As far as Myself, As I Posted on the Page 2 Thread, when My Case Closes I will be Glad and Will Help others By showing them the Past Case Laws I am Using to Win My Case, and I will also Share the 3 or 4 New Case Laws My Case is going to Produce! Our common enemy is powerful and well funded, it is true. We did not ask to be engaged in this. We just went to work one day.
I can not sit and pretend to be content with the scraps I am thrown. I can not sit idly while my working brothers and sisters are left to rot by the roadside because their injuries prove to be too expensive. I am angry because I feel, with evey fiber of my being, that I am being deprived of something I am entitled to, both as an American and as a human being. We are not pieces of machinery to be left to rust in a field, when we become too expensive to fix. Like you I wish to win one case. In the case I would like to win, the verdict would read "Never again shall a worker be seperated to be treated unequally because of the cost of his injury, because of a pre-existing condition, because of any other human frailty, or because of fraudulent practices. There will not be "justice for most" THERE WILL BE JUSTICE FOR ALL! |

I'm worried about you. Mental claims can be difficult. In my experience the insurer will immediately try every dirty tactic to discourage and discredit you. This includes: 1.) the deposition (used mainly to lock you in to answers, so they can ask the same question later, hoping you'll give a different answer, thereby discrediting yourself) 2.) surveillance: You must be alert to this. It might be helpful to keep a log of dates and times. Report it to your attorney. Call the police if you wish. In my instance surveillance was used as a harassment technique. It was excessive and included an intrusion into my home (hand delivery of benefit check-may I use your phone? etc.) In my case, surveillance revealed nothing, but the insurer attempted to force an early settlement by pretending they had video tape evidence which would destroy my claim. The good news is that your attorney can ask for any surveillance evidence to be handed over. If they don't provide it they can't use it later. 3.) Review of any and all records of any mental health treatment you may ever have had. You have some protection here, but you may have to insist that your attorney protect you. Know the law in your state. You should have the right to review what will be released, before it is released. Use this right. Question the relevance of any records to your case. If you need to release past records to proceed with your claim, ask that a judge review the records in private to determine their relevance. Fight hard about this. Write back if you need more help. 4.) Psychological Medical Exam. Check out all doctors before you go. Punch their name into google and you state comp site and learn what you can. Object if you have reason. Take someone with you. I could say more. I wouldn't want to discourage you from bringing your claim foward, but don't enter this blindly. You can absolutely control the way a lot of this goes down. If your truthful, it takes away a lot of the insurers weapons. I'll be thinking about you. |
