What do I do now?
Took ya-all’s advice and went to see a lawyer after 13 months of TTD, and no immediate issues with WC or the IC. Lawyer took some info at this initial consultation, and said he would get back to me. Well yesterday I received his packet, and am a little puzzled, under the fee agreement; remember live in Ohio, filed in Kentucky:
• 20% of the first $25,000 • 15% of the balance • All expenses, filling fees, deposition fees, medical records, court reporter fees, mileage, ect • Include in the 20% is the $30,000 TTD biweekly checks, I already received Taking credit for the $30,000 I have already received seems to be out-of-line to me. Is this the norm? In a settlement in KY, is there a specific amount of total weeks to calculate your settlement, if so, do they subtract TTD weeks that you have already received? |

I live in Kansas and according to law the attorney recieves 25%.
The laws of each state define what an attorney can charge. Go to the top of this page and check out the information by state. I collected 3 monts of TTD before I hired my attorney and not once was it mentioned or in my contract that my attorney would recieve back pay. My attorney charges for copying and other expenses. I supply my attorney with the medical records I recieve from doctors and believe this may help lower expenses in the end. I would have a consult with another attorney and see if this attorney says the same thing about back TTD. |

I am in Mich. and my attorney has not touched my TTD ...or any TTD I received prior or aft retaining him. Lilly

Pote, that Sounds a Bit High, you May want to Check with a Few Others and get a Quote!! I'm in Pa, and My Contingency Agreement is Cut and Dry: 20% of any Winnings, I am not Responsible for ANY Fees and Costs, Depositions, Billable Hours, etc. Only when they Stopped Superceadeus for Me, which is Considered a Win, did the start Subtracting 20% of My Weekly Check. None of My Checks before I Hired My Firm were touched. When I Applied for SSDI, (Which by the Way My Attorney had Me do As Soon As I was Eligible), He told Me to contact them and Submit the Judges Order of Payment to the Attorney to My Local SS Office, and they raised My Monthly SSDI Allowance to Cover the 20% coming form My Check! Just My Opinion Pote, Shop Around a Bit More, I think You will find a Better Deal out there Somewhere! You may want to Check with Your Local Bar Association for a Referral to a few W/ Certified Attorneys to Talk to! Best of Luck, and I Hope You find One with a Better Fee Schedule!!

I am in Kansas and my attorney charges 25%. I was already getting TTD when I hired him and he's not taking any of it. When the attorney figured out the i/c was paying me the wrong amount of TTD, he still didn't take any of it, even the back pay he got for me. He is sending in my mileage now and isn't going to take any of that either.
I agree with the others. I would look for a different attorney. His percentage seems high and he shouldn't get any of what you were already getting. I wish you the best of luck in finding someone else. |
