AZ Gal Denial and Surveillance Question
The state finally faxed the denial letter to our attorney and he called the adjuster. Originally she stated I was not at the office during work hours, however, Lorri Ann has a fax where she was ordered in the office early. So they backed off that. Then they claim she intentionally pulled the file cabinet on top of her, however, they do not have any witnesses. A state employee heard the file cabinet fall and heard Lorri Ann groan. Seconds later she found the file cabinet laying across Lorri Ann.

Lorri Ann is not doing well. She is blacking out and both arms from shoulder to below her elbows and completely black and blue. The attorney has me take pics of her arms. Her other symptoms are either the same or worsening. She went to one neurologist and she refused to see Lorri Ann. Now Lorri Ann has another appointment with a different one in December. The attorney states we are moving forward and will have a hearing before the end of the year. However, in the interim, he will file orders for loss of pay and medical. He claims the adjuster also stated they originally denied the claim because they could not decide within the 21 days and they want to continue their investigation. Our attorney states the burden of proof is on the state and not on us and is confident.

I fear the slowness of treatment will cause permanent damage.

My question is regarding surveillance. We live on a lake and the entire back of our house is glass. Is it legal for someone to be across the lake or take a boat to the back of our house and take pictures of inside the house? When do they usually start surveillance? I guess that was 2 questions.

Oh larry i am so sorry you are going threw all of this its just terrible how people can be so in human to others and have no care..I am sure this will all turn out ok..BUt dont delay the medical treatment because Lori Anns health is #1....Hang in there and keep us posted and tell her i said hello and she is in my prayers...MEL

I know in VA, they are allowed to do that. I live in a ground level apnt. building and I had my blinds down...but opened. I was standing in the kitchen (which looks out the patio door, and I looked up when I saw a bright light go off. I looked up and out the door and there was a man standing in the grass (right outside my back door) taking a picture.

It sure sounds like stalking to me also. As far as when the surveillance begins I have no idea. Maybe it would depend on how deep the I/C's pockets are. I've heard that P.I. work is pretty high priced.

I have a hard time with this...if you two are what you say you are then there could be danger or you could be pulling our legs either way you should know what is right to do in this instance.....

BELIEVE ME,WHEN IT COMES TO DENYING/DISPROVING A CLAIM,THEIR POCKETS ARE VERY DEEP.IF THERE IS ANY QUESTION IN THEIR MIND ABOUT THE VALIDITY OF THE CLAIM THE I/C AND THEIR INVESTIGATERS WILL FOLLOW IT TO THE END!!!!!!GOOD LUCK!!!!!

I am sorry that there seems to be a trust issue here but it is understandable because that is also two way street. Hopefully that will change in time. I have only been in the W/C system a little over a month yet I've been off work since before summer began. It took some time before I was referred to the correct medical field and there was more focus on the reason I was sick and not just treating symtoms. I have seen many bad things happen to people that I work with and until I was actually in the system I did not realize how heartless and ruthless these people are. The company I am employeed at is self-insured and I believe that may make it worse.
