new job
i am currently receiving workers comp checks..
but i just found a new part time job 20hours. does that mean my workers comp checks will stop? who should i notify about this .... |

Hi there.
Give your State please, so someone can help you. I believe WC checks continue and make up the difference to amount to what you have been receiving. But it could be different in different states, thus the reason we need to know. Some one with more knowledge than me will answer you soon though. Take care, and congrats on the new job! Lilly

Each state is different. In PA you continue to receive 2/3 of the difference between your time of injury average weekly wage and your actual earnings for a period of up to, but not greater than, 500 weeks.

Remember if a doctor has you off work - then there is a reason behind that - and if you can work a part time job - then why does he have you off work? The first thing you need to do is discuss the situation about the job over with your doctor. Make sure about your restrictions and get them in writing. If you are then able to work and stay within those restrictions then by all means go for it.
I think there is a difference between having a part time job prior to the injury and starting one after the injury. I am not trying to sound mean or anything just being realistic and this is the way an IC or an employer may look it as well. So if your PT job allows you to sit and answer phones for 4 hours, then why can't you do the same for your employer that you got injured at? (This is just an example since I don't know what type of part time job you got) Ok done being the devil's advocate here. I wish you luck on your part time job, but please do check things out as they may really compromise your healing process that the doctor has planned for you. |

thanks for the replies so far...
well here is the deal... i got fired from my original job after i filled out the FMLA and then they decided to can me after the FMLA expired... so i got fired on october 3rd.. the new job is only 20 hours per week... I am in New York state.. the thing is, I am only getting 300 every two weeks from workers comp... so maybe it is a waste of my time to even try to get any remaining scraps.... tired of being in the freaking workers comp mess anyway, Geesh! you get injured and they make it seem like it is your fault and that you are faking it or doing it on purpose... crazy |

Not to be bleak. I also am not familar with other states outside of Colorado but you should be very careful. I was warned not to take any employment while on Temporary Disability as the IC may argue that by me taking another job constituted me quiting the job I was injured on. In Colorado this could mean all of my benefits go away. More simply make sure you are not giving the IC any argument that you quit your job.
Make sure it is understood you want to return to your job. Even if you won't be able too or you don't want too. Your termination needs to be connected or because of your injury not because you quit (took another job). |
