Question for a friend
A freind of mine was denied compensation on her hand.She got a lawyer,went in front of judge to make an appeal.She is suppose to have a hearing,but I don't think a date is set for it yet.Today she got a letter from WC saying that she is to see a DD for an impariment rating next week.She can't get in touch with her lawyer and he is not calling her back after leaving messages.Does she have to go to this appointment?

Keep calling your lawyer because you have to go! That will give them a reason to close your case. Make sure you let your lawyer know about the appeal!

An Impairment rating so soon?? How Long has this Friend been Injured? This seems a bit Fast, they should drive, if they can to the Attorneys Office and Wait to see someone from the Firm to get answers! They must attend the Appt. if the Attorney doesn't Contest it, but I think Your friend should at least have the opportunity to have the attorney review the request!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

Sounds a little strange, almost all letters sould go through the Attorney she / he has before she gets the letter. The Attorney should be on record with the W/C Board.

This is how it went-She had an operation for hand last September.She got an impairment rating of 2%,but the emg and ncv showed she had carpal tunnel.She never signed the papers for release,but the DD said that she didn't need a carpal tunnel operation on his findings.She got an appeal a few weeks ago.Judge said that she had to wait 20 days for a hearing to be set.This is the problem,her lawyer has moved and she doesn't know where he is so she can't go to his office.She has left messages,but he is not returning her calls.Yes, he should have received the letter for appt. with DD also.She is scared,because she doesn't know what to do.I told her I thought she had to go,bcause it came from WC and not IC.Her hand is really messed up.She continues to work and her doctor has put a splint on thumb.Doctor says she needs operation now.CTS is bad.Her appt is on Oct. 30th.

I believe the DD is arranged thru the TWCC. your friend won't get the appeal heard if they won't allow an exam.
