Rights?
2 months ago I suffered an upper back injury at work. I am finally getting started with Pain Management since medications are not working. Last night when I informed my "boss" that I needed at the very least the 18th of October off, Thursday, due to appointments that couldn't be scheduled for any other day but Thursdays, he informed me that I would have to work anyways. That I would work when he says I will work. That I have to get my appointment rescheduled for Wednesday and he would give me Wednesday off. I informed him that if I could get the appointment on a Wednesday that I could work my shift. Again he told me (in front of another of my superiors) that I would work when he says I will work.

I have made 3 attempts to report this issue via our "Employee Hotline" to only get a voice mail and never a call back.

Do I have any rights in this matter? This will be the 2nd request for a day off due to medical appointments for this injury that he has refused, when I requested in the proper time frame. He refuses to allow me any Tuesdays or Thursdays off. Unfortunately the only available days for the type of treatments I will be getting are Mondays and Thursdays. Since I am a student and go to school on Tuesdays and Thursdays, if an appointment falls on either of those two days I either cant work that day or cant go to school and have the appointment. The Pain Management Center wants me to come every Monday and Thursday for a min of the next two weeks.

If You have a Current w/c Claim and it's been Approved, the Employer should make every attempt to Help You in obtaining the Care You Need. You may want to speak to Your Supervisors Superior, to get this problem Solved. Giving us a Little More Info. such as if you have an open claim, Your State, and any other pertinent info. would Help us a lot to Better answer Your Question. Generally state workers comp rules exclude treatment time.
Your company's leave policy covers time off for medical treatment.

Have you considered calling work comp and discussing the problem with them? I know they are generally seen as the enemy but that would be where I would start. I also suggest you ask your supervisor to sign a paper that says he is refusing to let you off for treatment you need, he might rethink his decision because he knows he is being out of line (or it will give you evidence of his conduct). Also look into the FMLA and see what rights you may have as far as requested time off for medical treatment, not sure on this but it is a place to start.

Rofl I got wrote up for not coming into work while on w/c .. Cant wait to see what lawyer thinks of that ... along with hassasssment papers too .

My place paid a huge fine for descrimation last yr for terming a employee ..
