Impairment Rating In Texas
Today I received my impairment rating. Here is the story.

DOI 8-12-05
8-15-05 Saw pcp. and started taking oral steriods.
8-22-05 Went to the emergency room
8-24-05 Micro disectomy/laminectom L5-S1
9-12-05 return to work on light duty.
10-?-05 Lumbar fusion with instrimentation L5-S1. Had pt and fce.
6-??-06 return to work on light duty.
12-?-06 released from work and sent home.
2-??-07 exploritory surgery S1 nerve root left portal. Had fce, pt, and another fce.
6-15-07 Filed for ssdi
7-??-07 Percutanious lysis of epidural
7-30-07 First denial from ssdi
8-??-07 Filed appeal for ssdi. employed law firm.
8-??-07 Filed with Department of Adult Rehabilitation Service
8-??-07 psych eval. Left early due to pain. Finished it a few days latter.
10-05-07 Psych eval.. Both neuro and pm doctors requesting scs. Left early due to pain. Will return on 10-11-07 to finish.

Symptoms, Chronic back pain, radiculopathy ( nerve damage ) both motion and sensory, left leg.

10-05-07 I received my rating. I do have an issue with the rating as well as a medical oppinion that was stated.

First, the opinion that was stated. Quote, THE CLINICAL CONDITION IS NOT LIKELY TO IMPROVE WITH FURTHER ACTIVE MEDICAL TREATMENT OR SURGICAL INTERVENTION. MEDICAL MAINTENCE CARE ONLY IS WARRENTED. Unquote.
It will be interesting to see what happens when the ic gets this. I am sure they will denie the scs. I am use to the denials on the first go around.

Second issue, There was no mention of the lower extremity. ( Left leg and left foot ). Maybe it is not suppose to be considered. I don't know. My neurosurgen allready told me to expect a ten percent rating. He also told me he wanted a copy of the rating the day I got it. I don't think he was happy when I told him what happened during the appointment with the STATE DESIGNATED DOCTOR.

The reason I am posting this is because when I was first injuried I was looking for answeres everywhere. Just like you. I felt panic, stupid of the unknown and hurt. Which breeds fear and anger. Hell, I even had a mental/emotional break down. I may have one tonight. I am not typing this for sympathy or compasion. I never read a post that told the story of what all happened to someone and thier impairment rating.

As far as my income. I went from over $900.00 a week to $539.00 a week to $377.00 a week. That will last until 4-??-08.

THE IMPAIRMENT RATING IS 10%.

This old red neck will be fine. I will figure something out.

Hi AQA,After the first impairment rating,you can not except it and get another rating done in Texas.I haven't had mine yet,but will very soon.I have not met one person yet that has excepted their first rating.For some strange reason they never seem to be quite right and the second one from all I have talked to are higher than the first.Hmm...Makes you wonder.

Do you have the chance to do get your own rating done ?

I see at one point you also was let go from job ... so who pays for you to sit at home while on fmla ? and then who pays ? looking for information for myself
