Im in Ms. Who is supposed to pay my health ins premium that I have at work while I am out on wc? my employer, wc or myself ? Ive looked all over the ms site and cant find this info anywhere...thanks

I know my employer paid for mine for 7 months while i was out of work till i terminated my employment. I was told when i first went on leave that i would have to repay it when and if i went back to work. I have not got a bill as of yet and it's been 1 month since i left.
Hopefully i won't get a bill either. KNOCK ON WOOD!!! I live in NH. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

If your employment is protected by FMLA then the employer is required to offer you the cobra option. Workers comp does not cover payment of other employer offered programs-only wages.

IT DEPENDS,IF YOU WERE PAYING THEM BEFORE YOUR INJURY, THEN THE EMPLOYER WILL EXPECT YOU TO CONTINUE TO PAY YOUR SHARE OF THE PREMIUMS...BUT IF THE EMPLOYER WAS PAYING THE TOTAL AMOUNT BEFORE YOUR INJURY,THEN THEY SHOULD CONTINUE TO PAY UNTIL SUCH A TIME THAT YOU ARE EITHER TERMINATED OR YOUR LEAVE IS USED UP.....IF YOU HAVE AN EMPLOYEE HANDBOOK ,CHECK IT,IT MIGHT TELL YOU WHAT YOUR EMPLOYERS POLICIES ARE...BY THE WAY, WELCOME TO THE FORUM!!!!!!!!!!

My employer has been paying mine for 16 months now. I am sure I will be terminated shortly and that will end. I will then be eligible for COBRA. it is up to the employer. If it's in a handbook it's gospel. In my case the employer has always paid the benefits of IW on Wc so it became an implied contract and they had no choice but to pay mine once I won my case. They also reimbursed me for the 8 months that I paid. it until I won my case.

My employer paid fo mine, untill my 12 weeks FMLA ran out and I was terminated then they offered me Cobra, So it may depend on the employer and there policies. You can always check with your carrier or Your HR dept if you have one.

The best way to find this information is to review your employees handbook as suggested by Truckster. By law they are not required to pay any health insurance premium, however, if it is part of your employment package then that is what they will continue through your FMLA period. So if they pay an amount but you have been paying part as a part of your package then, you would continue to pay that while you are on W/C and FMLA. Welcome to the board. Hi.
I had to pay my own monthly premiums....suck as it may....that was our policy. I was very cafeful about paying it on time...as I knew they'd drop me like a dirty shirt, the first chance they got. Problem was....that my superior would drag her feet turning my check in to HR......often making my payment late. Thank goodness I paid by check which were always paid and dated prior to overdue time. Did they get on her (Jayne's lame attempt to bypass the Bad Word Filter)? No, I'm sure they did not....did they get on mine? yes! and they were promptly reminded that it wasn't my fault the mngr didn't do her duties in a timely manner... like she always practiced. If she felt the task wasn't important or beneficial to her personally....she ignored it. Once I became MMI....I was promptly terminated....so the insurance was dropped & Cobra offered. Hi all...i do think the key to the answer here is "Company Policy". Some employers do and some dont'. If a policy is written somewhere it is easier to understand. FMLA will protect you for 12 weeks. In my case there is nothing written BUT being there for 20 years I KNOW that my employer's policy is to pay for all health benefits of all FT employees on WC. When I won my case I sent them a letter requesting that they reimburse me all money that I paid out while my case was in litigation and to please , in fairness to me, reusme paying my health benefits. They have agreed. I am still waiting for a letter from them because I am sure this will notbe an indefinite period of time before I am termianted and offerend COBRA at my expense. The reason I requested this is even though itisn't written it is an implied contract. If they have done for one employee they have to do for all. I guess they knew that.
