return to work
When and If I'm able to return to work, do I have to return to the same company? And what can of worms do I open myself to? Would love to hear all options. Thanks

No, you dont have to return to the same company unless you are under a contract with them. If no contract, then you are an "at will" employee. Meaning you can quit when you feel like it, and they can fire ya.
What I was told, because I really dont want to go back to work for the same company, if the dr releases me to work and I quit my job, if I was getting TTD payments, they would stop. But I could try for unemployment. I dread Wednesday, because its possible at that time I might have to make that decision whether to quit or return to work. I dont want to be put thru what I was put thru when I returned to work after the first surgery, the harassment sucked! If it was just me in my household, the decision would be easy, id say see ya! But since I have a small child, it makes it much harder to just leave there. Good Luck to ya

hi all...just some food for thought...if you quit and do not return to work and if the company was paying for your health group insurance while you were out, in most states, they can ask that you repay what they have paid while you were out. If they didn't than it is not an issue. Just check this out before making any major plans that may hurt you in the long run.

Even if youre out on a personal leave? Im not out on fmla, or on a comp leave or sick leave for that matter. They classified my leave as a personal leave of absence. Not to mention, they are the ones keeping me off right now. Dr said I could work, just with the one hand only. Company said no. If the dr lightens up some of the restrictions, like actually allows me to use my arm a tad, the company can say ok, come back to work. As much as I miss working, ( I really do, this sitting home sucks) im not sure if im ready to go back to being harassed. Its been nice the last month or so, theyve left me alone. But then again if my former coworker is correct in what she did hear, I wont have to worry about it, because she was told I wasnt returning.

I know the dread you feel. I've been with this company for 23 years and for the most part up until 3 years ago I liked my job. This is my 6th comp claim in 10 years from repetitive injuries. I don't think I can return without further injury. The harassment, job pressure, serious ongoing stress, chronic overtime, the physical demands, exposure to risk just aren't worth my health anymore. I really don't want to kiss 23 years of raises good-bye but coming to realize some things are worth the money.

Maybe with vocational rehab you can enter into a whole new occupational all together where you will be much happier and not have to deal the the stress of repetitive injuries and stuff. I do know what you mean though!
