I need some info
I have been talking to my hubby about my knee not getting no better . my hubby does not think that I can go back to do what i was doing at work. I was pulling pallets that weighed over 2500 lbs. I was squating all the time and i only got to sit down for 20 min a day. the doc has my restrictions that i can alternate sitting and standing for pain control. i loose my balance alot. he wants me to file for disabilty. if I do will it hurt my wc case? i dont know where to start or when to apply. so I wait till I get a disabilaty rating? or wait till i have permeant rastrictions?

Do on to others as you would want them to do on to you

you can check out http://www.ssa.gov for where to start for applying for disability. Normally one has to be off work to apply. As far as hurting your case - it shouldn't however, there may be a medical set aside from WC for any treatment that you need for your knee in the future if it is not covered under future medical.

sis, In my mind it makes no sense to wait. I wish I had filed for ssdi before I did. When I did file the gentleman at ss asked why I waited so long to apply? I told him, because I planed on going back to work. As far as will filing hurt your wc case. I don't see how filing could hurt anyones case. You can apply online. Your wc disabilty/ir has nothing to do with ssdi. Your disability/ir is based on your injury, ssdi will look at whether or not you can work. On another note, I was told while I was at the ss office that if I got denied to appeal it untill I saw a judge. If there is a year that you don't contribute to your social security it will count against you at retirement. Take Care.

Social Security Administration has two programs for disabled adults.

SSI
Eligibility is based on the applicant’s disability and all household income.
This program is for the lower income households.

SSD
Eligibility is based on the applicant’s disability alone, not the household income.

If I remember correctly your have both knees injured.
When I called my attorney and told him I would be needing bilateral knee replacements, he told me to file for social security disability.
He said if both knee are involved then I would have a good chance of getting it.

I applied on Jan 30, 2007 and qualified for SSD March 15th, 6 weeks later. Understand it is very unusual to qualify this quickly. Most people are denied two for more times when they apply with SSA.

My interview with Social Security Administration at my request was done in their office, and I had originals of complete medical records.

I also am hearing impaired, have a tumor in the bone morrow of my T12 vertebrae and have S1 leg/nerve radiculpothy.

So it wasn't just my knees that qualified my so quickly.

Disability Determination Services, a separate agency makes the decision
if an individual’s disability meets the agency's guidelines.

Hi, I applied to SSD while on WC......hasn't been a problem at all. I suggest applying for it now.
