Smile Update on my husband
We got paperwork in the mail today from his lawyer. 1st off he has an appointment to see a new doctor on the 19th re: his elbow. Hopefully they will finally take an MRI of it and hopefully do surgery. 2nd we got other paperwork requesting w/c appeals board for a hearing to be set up re: Declaration of Readiness to proceed. Hopefully this court date won't get cancelled again considering it took us a whole year to get this one (possibly)set since the last one was cancelled.

Can I ask a stupid question? is the Declaration of readiness to proceed on your behalf, because wc denied the mri, and such? the reason I'm asking is, workman's comp denied my claim since day one, and my attorney doesn't seem to be doing anything for me, except procrastinating...I would like to have a MRI on my shoulder, but they refuse even that, and I can't afford it on my own, among other things...I want to mention the declaration of readiness to proceed to my atty, keep him on his toes..if you know what I mean? thanks for any help you can give me

I know how it is to deal with the waiting game in WC courts. Hopefully when you go on the 19th you will find out more-Do you have a court date yet? hopefully if so there won't be any delays or maybe just maybe the IC will come to their senses and do what is right - which sometimes happens prior to the court hearing because of penalties.

Honestly, I don't understand very much of this whole w/c thing at all. My huband injured his arm when he fell(also same time he hurt his back). W/C has denied his claim from the beginning. They said he never got injured on the job even though he has 2 witnesses and he went to the emergency room the same night he was injured because he was in so much pain. He ended up seeing a dr for tests/treatment of his back but they never did an MRI of his arm. The past week when he met with w/c and the drs all they did was talk about his back. Finally my husband said what about my arm and then showed them his arm. Once they saw his arm they said he needed an MRI. Why they didn't do an MRI back in 2004 I don't know. Any way he had a mandatory settlement conference set last November but it never happened. So now after almost an entire year his lawyer is trying to get another one set. I am hoping and praying that this one gets set. I probably didn't even answer your question but like I said I really don't understand much of this. Oh and the declartion of readiness to proceed in on my husbands behalf.

I think I understand now...the kinda the same thing with me denied from beginning 2 issues neck and right arm, I email my attorney last night but haven't heard from him yet...don't know if that is good or bad...thank you for the information..
