A quick question
I am in the middle of a workman's comp case. The claim has been filed and I have an appointment to see a doctor next week. I have been informed that until I have seen the doctor, I will not start to recieve benefits. I was employeed and at work at the time of the incident, but have not returned to since. Does anyone know if I quit my job at this point, will it affect my claim or any of my benefits associated with the claim? Thanks for your help!

We would need to know what state you are in, in order for someone to give you state specific info. Generally speaking, if you stop working on your own ( not your dr. stopping you from working) You would not receive monitary benefits.

I am in California. So, generally speaking I should not quit until after I have been assessed by a doctor? If I start looking for another job, but do not begin working until after seeing a doctor, will my case be jeopardized?

No changing employment won't affect benefits or your case.
workers comp is not like health insurance - it's not you that's covered.

The employer is covered for your claim. As long as you have a claim there is coverage available. If you change employers you are still eligible for benefits.

Hi Worker,

I am in Ca. also. You are entitled to comp. after the 3rd day of being off, with the first three days being paid if you are off longer then 2 weeks. It has nothing to do with when you went to the doctor It's the law. Second if you are being compensated and you are to injuried to work why would you want to quit your job anyway unless you were quitting anyway?

Thank you so much. It is probably a basic and easy question, but I have not been able to find any information regarding it. I haven't felt comfortable asking my employer in fear that it would affect things. The workman's comp process has taken so long that my appointment to see a doctor isn't until 1 month after the incident occured. Because the incident was psychological rather than physical, I know I don't want to return to the same workplace, but am ready to do something else. I have been wanting to look for a new job for a while now, but not sure how to proceed. Your information has been invaluable and now I feel I can go out and contribute to the world Smile Thank you again!!

Thanks for the info RH! I am looking to quit because my injury was psychological and I am no longer comfortable in the place I was working, which is unfortunate as I really liked it there. Unfortunately, my workman's comp benefits won't be great (as I only worked part time) so I am anxious to get a new job. Thanks again for your help!
