California workers: bill to change workers comp will be up for a vote this weeK
a last minute bill was added on friday with a vote this week. It will radically change california workers benefits. contact your state legislator to give your opinion.

do more then shout into void about workers comp. give your opinion to someone that can make a difference: your legislator.

I just don't want to see people who work in the workers comp arena lose their jobs, lots of them are gonna lose their careers.

Like I said in another post, many of the arguments being put forward against it (and tossed out at the legislatures doorstep) are pretty specious. I very seriously doubt the reforms would hurt, and it isn't as they they are turning into Utah, Arizona, or some other draconian state where the IC quite literally controls the claim.

As it stands, the reforms would least benefit attorneys (both applicant and defense) and arguably lien claimants. I'll refrain from making the usual lawyer joke here.

I read that it will be harder for the injured worker to get a permanent disablity rating that's fair , that's why they want to raise the permanent disability amount because they know it wont be a high rating.It sounds like injured workers' wont be able to litigate for anything besides PD, no more extras, like sleep or psyche claims which will lower the amount of the award, therefor I dont agree with the senate bill and plus it will cut lots of jobs.

Yes, that's an argument. Generally those making it are citing loss of earning capacity (Ogilve) awards. I would bet at least 70% of litigated comp claims don't even litigate the matter. Making those arguments is a pain, and will draw the claim out for much longer. In order to even establish DFE, it needs to be a year later.

The extras, psych, sleep, "stress" sexual dysfunction etc are there only to make the settlement value higher, as a general rule. This is not to say that someone has an injury, surgery etc, doesn't improve, and sometime down the line isn't suffering from anxiety or something from it and shouldn't be entitled to treatment for it (which the bill does not disallow). However, the way things usually work is a person gets an attorney and all of the above is added, with no medical evidence that it exists.

More than PD can be litigated, but issues like medical treatment disputes will be resolved via an independent medical review, rather than in court. Makes more sense a doctor making the call and not a judge, right?

As for the jobs, I'm not certain what jobs will be lost?
