i was injurd in 2010 and had 8 months of therapy was release with permanent restrictions no surgury yet.so i cant do my job of driving no more.company said they had work for me.i have been cleaning up around the warehouse for 9 months now. no overtime or anything and drive 700 miles aweek to do this.last week i was informed that they dont have full time work for me anymore and now i lose my insurence and w/c is paying the other 20 hours that my job cut from me.now i have to go to my doctor to have some new papers filled out to see if they can still offer me part time work or if they will give me a leave of absence. and my lawyer said they are low balling us and he knows this case is worth more and that he,s setting it up to go to court. is this normal now whats happens.i had a injured neck doctor might do surgury still have pain. hands get tinglling and hurt dont know what to do and how long this waiting game will last

every case is different-involving different employers, workers, adjusters, carriers, doctors, etc. but serious injuries take a long time to get resolved and when attys are involved it takes even longer.
some states provide vocational rehabilitation to help workers get into another career.
there is no set time for the court or workers comp to do anything and there is little the worker can do to speed it up.
you'll have to look into unemployment benefits.

w/c is going to pay me the diffrence with going to part time from full time.but i dont understand after almost a year of being back to work on permanent resrtictions why would they do this now.i thought they cant fire you or anything before your case is settled or its bad for them.to me this is like the same thing i,m sure once i give them back the papers from the doctor they will let me go.and i have never heard a offer from w/c or anything yet

RE: still injured now what
if your lawyer said "they are low balling you" then there has been a settlement offer from the company but the lawyer doesn't think it's high enough. if you are going to court then the judge will look at the evidence from both sides as to how the injury affected your future earnings and will decide how much is fair.

you can fnd out more about Illinois work comp by reading the handbook here:
