It's strange how in some cases that SSDI is approved, like my son's in less than 4 months when he had never worked. Then other's like yours Bronco is a struggle despite overwhelming evidence.

Yrs ago a member of our church at age 24 was paralyzed from the neck down in an MVA, first application for SSDI was also denied so his lawyer asked for a court hearing. That way the judge could see his client, unable to move, hooked up to a ventilator with two nurses in tow. The SSDI was approved immediately, in other words it was stupid that it was denied. Someone screwed up in the paperwork obviously, Social Security said it was denied due to his age.

Bummer the word you're off on is Arachnoiditis, just think of the spider. Originally called that because the nerves become entangled like a web.

Hope you get that approval soon Bronco, I'd say let your lawyer handle it.

I can't believe they denied you! Your injuries are similar to my husbands. Age would be the only difference. He was 46 when he was hurt. Appeal! I believe the Dr 's his lawyer sent him too made the difference. Especially the work rehabilitionist. Has your lawyer sent you to one? The report from them is lengthy and states all jobs qualified for along with requirement followed by the evidence you can NO LONGER do any of them. It does the determination workers job for them.

I guess its who ever is working on ones file... Now my father, rsd, low back, and I believe age 48 took 3 times last one was before the judge and approved.. My mother, was a stay at home mom, foster home, emphysema at age 60 3 weeks approved..

My attorneys partner who does all of the ssdi and the vr, sent me to a retraining counsler, and his conclusion was not able to retrain due to the pain and concentration issues with the meds.... And they did a interview of me...


I was shocked to see the letter of denial, but its like any other programs, holes in the system, not enough workers, etc...
I called my local ss department and asked for a copy of the files they used to determine... I was asked to call back on Mon when there would be more time to assist me.......

Bronco some disabilities under SSA receive automatic approval. Cancer, blindness, are two of the disabilities. Emphysema may be among those disabilities.

I was approved within six weeks of applying, Disability Determination Services called shortly after I applied for SSDI and asked if I had any other medical condition I had not listed on the application. I was scheduled to have a CAT in a few days due a tumor on the spine. I was instructed by DDS to call them with the results of the CAT, I did so with the name of the hospital where the testing was done. The testing confirmed the tumor on T-12 and I was approved for SSDI the day I called DDS with the results.

While re reading the letter I was looking at some of the dates that they recieved the records.. I now realize one important record at my last appoinment with my injury dr doesnt correspond with the date they recieved the records... Of course this was my mmi report of my back and stating I could never work a full time job with a list of all my restrictions,, Importantly the one that states I can only work 2 to 4 hrs per day with limited time for rest and must chane positions...

I dont know if that would hurt me, at the same time it says I can work but could not retain full employment......IDK......I will have to wait til monday and hopefully I can get the records they used to see if somthing else was missing..

I'm sorry. He was a vocational rehabilitation counselor. He went over his complete work history from his first job till injured. His report was very detailed with jobs, job codes, qualification, requirements and everything else all listed separately. Once the report finishes going thru all the jobs he goes over the retraining and or schooling. When he was at the appt with him he did the interview but he also did testing as well. Comprehension, math, hand eye coordination and several others. It's been a while since I've looked at the ssdi web site but remember the report stating him being disabled using the same steps ssdi does. When i dropped the report off at the office i had a note with it for her to check the persons qualifications and reputation.

I thought that was what you were talking about, I have also done the same already but when I did mine it was ment for my wc case.. But none the less should work for the ssdi claim....

All I can say is it is very important to go over your own medical records to look for discrepencies in the actual "reports". I have found many inaccurate reportings in my records that had to be corrected! You have a right to your own medical file no matter where it is from! You sign a release from each doctor saying you want all of your files, notes, dictations etc and they have to give them to you. I was 40 when I applied. I was denied the 1st time and was approved on appeal within a 6 month window...through the mail. Good luck!!!
All I can say is it is very important to go over your own medical records to look for discrepencies in the actual "reports". I have found many inaccurate reportings in my records that had to be corrected! You have a right to your own medical file no matter where it is from! You sign a release from each doctor saying you want all of your files, notes, dictations etc and they have to give them to you. I was 40 when I applied. As stated prior, ask for a disc with all your records that were received/used for the determination. Make sure that ALL medical records... from all WC drs, therapists, VR etc are included. It doesn't matter if you saw the Dr one time. Also any other medical records you have such as PCP, neuro, etc that you might have seen in the last 10 years. Also all tests... MRI's, CT's, EMG/NCS etc. All of these records are important.

I applied at 45 years of age and was approved in 71 days with the assistance of an attorney. If I were you, I would have your attorney help with at least the wording of your appeal, as that has a lot to do with how the person reading it and going back over your claim will look at everything.

If there are conflicting reports between Dr's on whether they feel you can/can't work, don't be surprised if on your appeal, you are required to see one of SSDI's Dr's to clarify your ability to do certain things.

Do you have any record of depression?? This is a big one for SSDI. Due to all your injuries, inability to work, inability to do the things you once loved to do, inability to care for your infant son in a manner in which you should.. these can all be big factors for depression. If you haven't had to deal with depression nor see a Dr for it, I applaud you. You are one strong man not to let all of this get to you.

If I can help you in any way, just let me know and I will do all I can. I hate to see you lose everything after coming all this way in your battle.

I have always have been strong minded, I get that from my mother... Even though lately my world seems to be falling apart I keep trying to think tomorows another day.. It's starting to eat away at me lately but even the shrinks the pm clinic has sent me to in the past shows me not a sign of depression but thats been 2 years ago... But the axiety is documented and is being controlled by meds (fluoxitine) and a little self awarness of the things that set it off...

I have not appealed as of yet, I have been waiting for the records of my last visit with my injury dr, in which by the dates of records ssa does not have them.. It was my end of healing and a list of restrictions and some forms similar to what a member here sent me to have filled out.... I have an appointment this week with my primary and am going to have him fill them out as well.. This way I know there aint nothing left out when I appeal... I would rather try the appeal again without the lawyer because there fee is 25%..


When I recieved the notice of the decision, the papers state I can have have it in person with my local ssa in which I will do..
