ssdi update.
Thier decision was, Im not considered disabled under the ss rules.... Well it looks like I have to file for reconsideration, I thought for sure I wouldnt have any problems.... It looks like they were waiting for my primary reports in which they recieved around 7-13 and yesterday I got the letter of denial.....
A few Questions, can a person request medical records that they reviewed...? I am courious as to know what my primary sent them on the 13th.. Should I appeal for reconsideration on my own..? Or should I let my attorney take over..? My attorney's aid felt they would turn me down the first time just soley because of my age.. In this letter they listed places Ive had treatment and below that they said and any other places I listed.. They pulled records from where I was recieving pt before I was released to work and after I was re-injured.. I feel any and allmost all of that information would be bias because of the ncm was constantly calling them trying to get them to push me forward so they would release me to work........ Any input or thouhts would be appreciated..... |

Bronco I believe at this point you need an attorney on board.
I have a friend of mine who has archnoitis, (spelling is off) This is a very serious spinal condition that has fused the nerves of the spine like a tail. My friend will never work again and is on pain management. Work comp delayed medical treatment for 8 months, by then it was to late with pain management being the only form of treatment. My friend is 45, is an RN and physical therapist assist. Social Security denied her claim the first time around, she lost in reconsideration. She hired an attorney and again filed for SSDI, this time she got it. Her attorney foundout some medical records were submitted to late for social security to consdier them in there decision the first time. The attorney also foundout some medical records were never submitted at all the first time around. The attorney appealed the first decision. The SS court recently ruled on the appeal and found SSA make a mistake and my friend was disabled the first time around. My friend expects the back pay check to be deposited into her account any day. |

get an attorney your age may be a factor but not to worry your back pay will be huge.
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Bronco I was turned down the first time I applied. i had an attorney from day one. I did the reconsideration and was approved, so that would be the second time around. I was approved 6 months after I did the reconsideration... So get an attorney and refile,, make sure you file within the time frame allowed.

You might ask your attorney if he thinks you are going to be denied the almost 'required' 3 times before you are allowed to go in front of the ssdi judge. I got my first attorney between denial 1 and 2 I believe, then fired him between denial 2 and 3 when I felt he was getting nowhere. Hired my WC atty who allowed me to be denied the 3rd time then finally got in front of a judge.
I feel part of the problem was a lack of medical records for all that is wrong with me. My w/c injuries are only a small part of it and because I had no insurance I couldn't back the other illnesses/injuries up as I can now. I guess what I'm trying to say in a round about way is that if your attorney feels he/she can speed the process up then why put yourself through the aggravation? Just my opinion, probably won't help much but I wish you all the luck in the world and hope it made some kind of sense lol |

I talked with my attorney earlier today, he sugested I make the appeal today.. He will intervien (spelling) after I appeal , but I'm leary about this because he couldnt answer my questions on how I go about getting the medical records that they reviewed to come up with thier decision... How would I know what records they reviewed from the ones they didnt... WHen I appeal I would like to make sure they'd look at all of them incase they missed somthing the first time around......

Bronco,your best bet is to ask your SSDI worker 9 out of 10 they blew you out because of age or he didnt get any the night before he looked over your paperwork....they have to because of not enough people to work it....youe PCP is your best alli in this....Call your SSDI worker and get the ball rolling again and ask what all they are missing and how long to get before a judge

Bronco my wc attorney who I did not use for SSDI...as he only does WC and my SSDI attorney only did SSDI claims. But my wc attorney went to SSA and got a copy of my entire file sent it him on a cd..which he gave to me..it cost 15.00 and I paid him for it.. so check with the ss office and see if u can request a copy of your file on cd... it has everything on it that social security has in my file...worth call ing your local office and see if you can get one.

Thanks gang, I'm pretty sure they seen my age and was the factor in thier decision.. The timming just couldnt be any worse if it wasnt for my parents and inlaws we would be homeless soon... By fall we were hoping to pay them back, but what do we do....
C_F---- great idea, I will call there in a bit... I just feel they over looked somthing or somthing is missing.. I know I'm only 42 but I know a friend of mine is a few years younger and had both hips replaced and he is getting it. And he gets around better than me, but I know there more then just an appearence when figuring who gets it. |
