Permanent Disability in NJ
I am an injured worker in NJ back in 2005. My attorney told me I am deemed 100% disabled, yet I have never been given a permadency evaluation by the WC ? My attorney went to court last week to be awarded his payment of 100,000. I applied for SSD & did win, it was in 2009 I applied. The SSD told me they could only go back to Oct. 24,2007, & I should have applied in 2005 , they only go back 2 years.
Now my attorney is telling me I eill get no settlement, I will get the 450 weeks of 70% of my wages, yet I was a high wage earner and 70% is not even half my salary. The SSD does make up for the rest & gives me about 70%, I pay my own medicare, & paid my family insurance when I was working FT which was 150.00 s month. My attorney is telling me I dont hsve to worry about the medicare set a side, yet he says there are only a few 100 dollars Medicare paid, I have thousands of dollars in bills medicare paid that were WC? He said "why open a can if worms"? I am worried about not only Medicare coming back to me later, yet I paid 1200.00 a month in COBRA, for 18 months during that time this insurance picked up thousands of dollars in bills that should have been WC. My attorney said there is no lein so don't worry about it? The onlu thing I can think is that I worked at a hospital, & the surgery's, and many of the doctors were out of the same hospital. Something just doesn't feel right to me, my attorney has belittled me the whole time, telling me he has worked for nothing, he will never get back the time he has put into this case, & now he is suddenly being nice as can be.? For your own peace of mind talk to other comp attys about taking your case.
They'll have to share the fee. |
