Got some updates today..Attorney was approached back late last year,, wanting to see if I wanted to settle my claim and keep my future medical open. My attorney gave their attorney a number that I would settle for...We had not heard back from their attorney. My attorney has since sent them a couple of letters and still no response from employer. We are in the process of fileing for Permenant Total Disability... I have the application and fee structure laying here on my desk. I have had the application for about 6 weeks working on it a little here and there...I have a few more questions on it to fill in and then recopy it and was going to try to have it to my attorney next Monday. Well today I get a letter from the attorney ,he states he finally learned why there has been a delay concerning the settlement of my claims. I have 2 claims both with same employer. We were talking originally about an indeminity only settlement, and leaving the claims open for medical treatment. He says he has learned that my employer is also looking to potentially make an offer to completely settle my claims which would include my future medical. So he goes on and talks about the MSA Account and what has to be done with Medicare and what he has to find out from Meicare and on and on....I called his office to talk to him about the letter but he has gone for the day... Told them to leave him a note and I will call him back tomorrow.....So maybe I will be done with them sometime in the near future.... and get to move to the beach before the winter hits this year...
Since we had not heard anything for a long time... I assumed they were not interested in any kind of settlement any longer....Thought I would share this with everyone here..... What are some thoughts on settleing with closed medical and thoughts on keeping future medical open.... Those that settled with closed medical... what have u guys ran into .. with a MSA Account.... Cervical Fusion 2003, c5-c6. Herniated and damaged Disc L1- L4-L5 S1. Lumbar Spinal Cord stimulator implant 09-2008. Cervical ACDF revision with hardware c4-c5-c6-c7 Sept 2009. SSDI approved 3-2010. NOW OFFICIALY RETIRED |
