Does W/C cover for home help care,including transportation?
Hi, Me Montana. I have Tarlovs and have been not cleared to drive for 2 years now. I do love my home, but it is 8 mile outside the city. I did have home care with transportation previous to my admission to a pain clinic that cleared me as 80% improved etc. So home help was stopped. The real truth is that I am more disabled now than I was previous to that admission and this is now validation by the care home I am in currently in order to gain weight. The social worker, PTs and OTs and the nurse here said I would be ok to go home with home help, but the attorneys office told me during the meeting that although it is true that I am isolated and left out of the loop directly due to the injury...and unable to drive...it does not mean that workers comp has to provide help because I live far out. Actually, I live 10 minutes from the city centre, not in the mountains or off some distant dusty road. I live right off of the freeway. So I don't understand their logic. Also. Didn't they already set the precident by providing exactly this care prior to the pain clinic which failed so miserably? The attorney also said initially home help worked for me because the hours I was given was enough to get small things done in the home, and to get me out to shopping and the library, that sort of thing. But then all of the hours were taken up when the insurance company used all of the hours to book dr. appointments to physical therapy, which I was told by the neurosurgeon not to do, and to IME's to see if I was faking everything. The doctor, my own, ordered a home eval to see what type of care I would need. Instead W/C stepped in and ordered IME's. I have yet to have a home eval. Yet here at the care facility said I would be perfectly ok to go home if I had a few hours a week of some help along with some transportation. Why should I not be covered by this when I was before?
My daughter asked the social worker about medicare, seeing if I could get that, and they said it would be sticky with workers comp and difficult to get on it, but it may work, buy my attorney does not like the idea. Why? If it provides help. Now when I did home help, which is why I got injured, I traveled more than 50 miles a day back and forth between cities, even went up into mountain areas where the snow was so bad most cars could not make it. So what is the problem. This seems so easy to me. My attorney said it is apparent I thrive in conditions where I have the ability to get about and talk to people, sort of suggesting that I stay in this facility. Actually I prefer my own time, I just like to go out and get plants for my garden, visit book shops, have my hair done sometimes, just wander around the mall, the library etc. Walk along the river. None of which I could do here anyhow. I thrive when I can take physical therapy on days I can do it, because I love to work out. Not because I love the interaction. I love the work. Gives me a high. Makes me feel stronger mentally to fight this physically poor little body back into shape. Why spend so much on something that does not work when they could save so much on something that actually does????? And is it correct that W/C does not have to provide in home help even if it is proved that the injury is permanent and work related? The attorney said it may sound unfair, but it was the rules. Sounds phony to me. Help someone. |
