Unknown Problem
Hello everyone, my name is Stephen and my wife is in a pickle...
She was injured at work, they diagnosed it as a torn muscle around her shoulderblade. After treatment she is still in pain and they tryed 2 more times to diagnose her problem and have not found the cause of her continued pain. Now, they are cating like they are just gonna send her back to work in her current condition.(note: she was in no pain before the incident) I am in the process of getting a lawer on retainer just incase they do send her back without finding/fixing the problem, but are there any other ways of going about keeping them inline without a lawyer? |

RE: Unknown Problem
details depend on your state rules.
it's up to a doctor as to whether she is released to return to work. generally most states allow the worker to request a change of treating doctor or to get a second medical opinion. workers are not required to have an atty to appeal a decision of the carrier/employer. again the details depend what work comp rules your state follows |

RE: Unknown Problem
is the pain between her shoulderblades? or from her shoulderblades? and you dont need a lawyer on retainer as workmans comp lawyers work for a % of what they get for you...can you tell us your state and what kind of injury she had please it would help alot
;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....

RE: Unknown Problem
the pain is between her right shoulderblade and her spine. The state we live in is South Carolina. She has goten them to use our family doctor as the second opinion. she thought it was a slipped/ruptured disc in her neck but everything was normal. She also wanted to expand the MRI to her Thorasic Spine aswell but they refused to alow them to expand the MRI.
