Four Injuries
My husband was injured four times in two years, And now he is paying for all medical treatment at this time. All parties or ready to settle the case but I am wondering if each case have a different settlement value that would be combined to one settlement. Injuries or as follow mild to moderate ddd, 4 herniated disc in lumbar this is what the first physician treated him for even though he was complaining of neck pain also it wasn't examined no more than once until he was released from the treating physician to full duty 2 days after his visit to the er where he was diagnosed carpal tunnel syndrome even with pain still being present in the back and neck almost year later he had a x-ray and mri which showed bulging disc in the neck bone spurs straightening of the cervical spine. It was suspected but never diagnosed by the comp dr because there was authorization of medical treatment when it was requested it was said that the injury was pre existing from 6 years prior from a accident but he had no symptom or problems for years until the accident he had to under go psychiatry care for depression after not being able to treat until he paid his own physician an he has being treating for the lumbar spine also since being released. My question should the claims be calculated separate and then combined for a settlement amount

rules for providing work comp benefits are different in each state.
without knowing your husbands it's impossible to answer http://www.workerscompensation.com/forum...?tid=10146 there are many factors to be considered in answering as laws and benefit level change regularly both within a single state as well as when injuries involve multiple states, employers, or carriers. such complexity often requires litigation and a knowledge of specialized case law. |

under certain conditions, the impairments can be combined.
if multiple carriers/employers are involved, the document can detail the % liability allocation. it can be complex and an attorney familiar with relevant case law is recommended. |
