ppd questions
I was put at MMI in Dec. of 2010. I went from ttd checks to ppd checks in Jan 2011. My employer could not meet the restrictions placed upon me, so no work was offered.
Once 60 days past from when I was declared MMI, doesn't the ppd payments increase by 15% because I was not offered to come back to work? If so, am I entitled to getting back pay from when it was supposed to start through my current ppd check? Is there some sort of penalty because the insurance company hasn't paid it? My case is in California. Thank you. |

RE: ppd questions
Okay, that was simple. Thanks for your response.
I hunted around a WC book and cannot find what the penalty would be. Would you know where I can find that information or do you happen to have it available and can just post it? |

Thanks for your response. there are self-imposed automatic penalties and court ordered penalties. see Labor Code 5814: http://www.leginfo.ca.gov/cgi-bin/displa...=5800-5816 you should make written demand and notify them you will seek penalties. keep a copy. you can also file a complaint with the audit unit see I&A guide #14 http://www.dir.ca.gov/dwc/iwguides.html |
