confused on IME Impairment rating.........
Late 50`s female, worked 12hr shifts, pushed and pulled up to 350 lbs on skids, lifted 45 lbs consistantly. Worked circles around people half my age for 5 years. Never called off due to any back pain, just colds and flu.
Slipped and fell on backside on oiled floor. Dr.`s do MRI on lower back. All they see is DDD and should not cause the pain I`m in. Three Dr`s later, one discovers I injured my right SI Joint. Injects the joint and the pain lessened but returns. I can hardly walk 50 Yds IC sends me to IME after 6 months. His report says I just "aggravated" my DDD and I DID NOT have SI dysfunction. Says I was at MMI 6 months ago. Basicly lies about the whole thing in his report. My attorney recieved notice that the IC has stopped all benefits including MEDICAL. IME Dr gave me a 0% inpairment due to accident but penciled in (5% pre-exsisting) Went to the IME Dr. that my attorney sent me to and he said that he would add 3% to the impairment rating. Mt attorney is telling me that I cant be compensated for the Pre-exsistng 5 % just the added 3 %?!?! Is this correct??? The IC offered 10k last June, I felt that was to little, I asked for 18k.....the IC countered with 5k and my attorney says I might get 8k less his fee..... I keep hearing that SI Joint Dysfunction is hard to prove due to a fall. What a bunch of crap....... I just got my SSA and have a little coming in now......it whistled right thru Kentucky |

your employer is only liable for the percentage from the aggravation.
you can get another atty; a single fee will be shared. |

I believe if I'm correct around age 50 the si joints bond together.. Mine was fussed with a screw at age 38 due to a mva.. If yours were starting to bond you may have jared it enough to cause irratable pain.. Unless there was detection of fracture by mri it would clearly be hard to prove.. It hopefully will improve .......
