As previously stated, I had my DIME back on May 7th 2007 with a DR. that my attorney said was very "us" friendly. Now almost 4 months later he still has not sent in the report to wc and thus has been suspended from further exams until he gets his ")#@$)*" together. Would it be prudent to get another DIME? or wait for this "us" friendly Dr to send in his report? Thoughts??????

Welcome Gulf! My suggestion to you would be to get on Your Attorney's A** until you get the Report you need. If I'm correct, He sent you to Him Correct? I would get busy working on the Attorney to get things moving!! I Hope you get your Report, and Best of Luck!!Wink

Well, my attorney didnt actually send me to this Dr. but he has had a good experience with the Dr in the past. Another question, my attorney suggested I contact WC myself and check the status of this Dr's report. Any thoughts on that?

I contacted the Docs office and requested copies of all medical files to include the IME report....they faxed me a consent form I faxed it back and that evening out spewed the paperwork....sometimes its not the doc but his clerks that dont get things done....have you called the office or went there (if you are close) and asked for it?I got the report BEFORE my lawyer did and faxed it to him

I didnt think, by law I could have any contact with the Dr.?

In my case, I drove to my doctor and had them print me a copy of the report, and then I faxed it to my WC adjuster myself to get things started. It worked!, and I have that copy for my own records as well.

Golf you would be chatting with his nurse .. I always ask the front people for a copy of the reports and sign a paper to get them ..
I only got the run around from an ime to get that report .. started to state the laws then it changed after I complained to the adjuster .. Consult with lawyer told me that long time ago .

I have another question. My attorney and I feel 99% sure that the DIME Dr will agree with the original Dr.'s assessment of a 33% impairment rating. If, by chance, he doesnt, and he says I am NOT at MMI, does the I/C have to pay PPD from the original MMI date of Nov 9, 2006 until now?

Sithie is correct, until You are put at Official MMI, and if You don't dispute it and ask for a second opinion, You remain on TTD. The w/c Dr. that performed the IME on Me, over Two Years ago, put me at MMI, but we disputed his diagnosis, and I've been to countless Neuro., Ortho. and a Pm Dr. that disagrees, and my TTD continues until the Ruling from the Judge! This IME Dr. continues to give Diagnosis on Me and has only Read Reports over the last Two Years, has only seen Me once, and My Other Dr.'s have seen Me on a Regular Basis, and deem Me Totally Disabled. Now who do You think the Judge is going to find Credible? A Dr. that saw me Two Years ago, or My Current and Treating Physicians and Specialists? Even if the Judge chose to accept the IME decision, just look at the Appeal Evidence I Have! Best of Luck, and I Hope You don't have to see as many Dr.'s as I Have!!!Wink
