Tarlovs Cyst - cleared by w./c doctor to return to light duty????? Here we go again.
Hi again, Me looking for advice out there. Many will remember me as initially having a herniated disk at L5-S1, complicated by surgery when Tarlovs cysts were found and CFL was sorted out. Was approved by w/c that Tarlovs are a direct result of the injury.
After four years and two surgeries I am still in severe pain, and having been sent to a pain clinic in Florida in September for 5 weeks, they said that I was cleared at MMI. Even though they have documented falls, and said I was unable to walk out side or inside without escort. And when my neurosurgeon that this little escape cost me more time in recovery since they have not been allowing the nerves in the legs to settle at all post surgery one year ago. I had at four month post surgery physical therapy which went very badly and threw me into serious flair ups. I have balance issues, I have drop foot on the left side and constant severe pain day and night that I can not treat because of my allergic reactions to most of the meds I could treat with. My neurosurgeon said three weeks ago, and wrote, saying that I was not at MMI. My attorney is now looking at the jobs they have cleared me for and we have to discuss these before I see my own doctor tomorrow. He wants to ensure that my own doctor will concur with the neurosurgeon that I am not at MMI. I am at 83lbs in weight now. From a healthy 116 prior to the second surgery. Both the first and second were compromised by physical therapy and set me back in recovery. My neurosurgeon said he expects that we will have to wait another year at the very least, before the nerves settle enough to assess what permanent damage has been done. I still can not walk long distances. I can not stand or sit for prolonged periods and even my favourite way of relieving pain, lying on my side, does not work any longer. I can not drive because of the pain, and when I get to my destination I never know if I will be able to continue with my shopping or whatever it is I need to do because of the pain. The w/c accepted that it was a mistake to send me to the pain clinic and my nurse case manager was fired. This is when w/c have suddenly called in the hard guys to kick me off of benefits. My attorney is getting edgy. He knew that the doctor I saw two weeks ago who assessed me was biased towards w/c as is the next doctor I will see for a psychiatric work up in three weeks. I can see this ending up in court. What should I be looking at now. I sort of expected this in the line of things. It was a miracle that they even approved the second surgery and being sent from Montana to go to Kansas City for that surgery on the Tarlovs. It does not follow logical thinking that they would accept that Tarlovs is caused by an injury or heavy lifting, approve all the surgery, and the medications and the interventions etc, and then not accept what the same neurosurgeon they approved for the surgery had to say. That I am NOT at MMI. Also that they even admitted that sending me to the pain clinic for therapy and intervention was a very bad mistake and actually made my condition worse. I did warn them prior to going, as did my neurosurgeon and my attorney. They still sent me. Any ideas guy? |
