Workers Compensation and Social Security
If a person is on WC and wants to retire it has been mentioned that WC might conclude that the worker "Voluntarily" left the work force yet if that same worker applies for and receives an award for SSDI isn't that too voluntarily leaving the work force? After all you don't HAVE to apply for SSDI.

After all you don't HAVE to apply for SSDI. when you apply for ssdi you are not applying to leave the labor market. being disabled and out of the labor market is a pre-requisite. being disabled is not your choice--others make that decision for you. in any event such situations require legal or court determinations from your state. not all state work comp systems deny comp benefits to retirees. |
