Texas DD rating versus RME rating

My husband received a 15% whole body rating from his Designated doctor. Now the Insurance company hired an RME doctor to dispute the rating. Of course the ratings are totally opposite. All his doctors have agreed with the Designated doctor. What are chances the hired RME doctor can prevail?

Thanks, the RMR doctor has an awful rating from his patients and was flown from Dallas to Houston to perform the eval which is silly since we have tons of doctors in Houston. The DD has an excellent reputation and all of his doctors are highly qualified and have great credentials, to include a Psychiatrist, Toxicologist, and his primary care physician. He has been off work since a bad chemical exposure in May, 2010. The RME doctor puts him at 0% and returning to work 5 days after the accident. He has still not been released by any of his doctors to return to work.

anticipating how the comp court will weigh the medical evidence is best done by someone experienced with your court and the judge assigned. it's a very individual judgement. Each judge has their own method of evaluating persuasiveness, credibility, and reasonableness of the medical findings & doctor's conclusions.

even if their doctor has little or no credibility, the opinion can be used as a bargaining chip in negotiations as well as a basis for appeal.
the legal game is about improving your negotiating position not about going to court.
it's not about an all or nothing court decision but what can you argue and what concessions can you get for it.
most negotiations split the difference; that's why both sides go for the most extreme opinion--it lowers the mid-point.
