Toungue Exclusion in Owner Controlled Insurance Policy, Texas
I had asked a while back but had no comment, so I will try again. My husband worked for a subcontractor who had an Owner Controlled Insurance policy with the Contractor/Premises Owner. There is an exclusion in the policy that states " This policy does not cover any claim that arises directly from the work performed directly from the owner's employees. An OSHA investigation proves that an accidental major chemical release was solely caused by the work the owner's employee was doing that in turn hurt several people. TEXAS is where this occurred.

So I was wondering if anyone has any input on the situation and the probability of a 3rd part suit against the Contractor/Owner.
