Who sees the P & S report??
Hello:
Tomorrow I am being evaluated by my doctor for P&S. I am nervous about it. I don't know who gets this report other than the workers comp adjuster. I currently am back on my job, per my request, without any work restrictions. If there are restrictions, I can't work. Last year, I suffered 3 herniated cervical discs from an out of control patient, I work as a nurse. Anyhow, I wanted to know if my employer directly gets this report or just the adjuster. Also, if the doctor ends up givng me some type of permanent restriction so I don't get hurt further in the future, how will that affect my current job or any future job. Of course I worry about my condition getting worse over time which I know it will just based on the pain that I have now. I get through the day because I have to, I can't afford not to work. But, I know this report is something that is permanent and I am worried about it. Please advise.

your atty and the court if the claim is litigated.
you and the carrier if it's not.

per ADA law the employer is required to discuss reasonable accommodations; a blanket ban for any restrictions would be illegal.
restrictions for future injuries is not a legal work restriction in california; it has to be for current/present impairment.
you have 5 years from the injury date to file for increased permanent impairment. impairment solely for pain is limited.

I'm getting my first P&S this coming week. I don't know what to expect at all. It's only the psych that's doing it, not the medical doctors; yet. I would hope my ex-employer does not get to see it because it's one of their faults that I'm in the situation I'm in.

I get paid no benefits. My unemployment is almost done. What am I going to do then? I can't work. Next month I have my hearing for SSDI next month and pray the judge finds favor in my case.

I want my story be told somewhere. I don't feel my attorney is fighting for me. I can't find another one. Any advice? Sad

you should start a separate thread and not take over this one.

employer access is limited - only parts relevant to work modifications, diagnosis, & disability.
it's up to the doctor whether you will get a copy.
you should not be getting unemployment if you are disabled; that's what sdi is for.

workers comp is not about exposing employers; contact the media or you legislators.
