RE: Just fired from job
I did go to other webboards and ask patients who have had the suregery how they were doing now. It seems a majority were having the same if not more problems after surgery. Carpal tunnel patients seemed to recover well but Cubital Tunnel patietns had a lot of trouble and said they would not have to surgery if they would have known. So I decided to a least put it off for now till I have no choice. I'm going to ask the QME what he thinks about the sucess rate of the surgery and take that into consideration.

grundig, how do you know when it is really bad. Meaning my pain is pretty bad, can't rest arms on arm of couch because of the pain of the couch touching the elbows. Use sleeeping pills at night so when I move in sleep and arms touch something I don't wake up.

I think if you look at the ADA guidelines you might have a basis for a complaint

Discussing accommodation is not the same as bringing you back. It's the lack of a discussion that may be the basis for a complaint but that of course is your decision.
Cool
Many employers would rather pay the 15% increase then provide modified work.

Your date of injury does entitle you to supplemental job displacement benefits

Thanks 1171!!! You are very helpful as usual!Smile I will call the CA state wc hotline and ask about them not even having a discussion with me. The only conversation I've had with the benefits manager was my employment being terminated in Nov 2007 and my med benefits ending end of Sept. I then forwarded the doctors note yesterday in hopes of going back to work and called to confirm she had received it via email and she said she would need a week to let me know. The next day I got the email saying they can't.

Hi Star,

I think Ca. has a 104 week limit on w/c then you must apply for ssdi. Your LTD, I have private temp. insurance with Combined(great company). They have a limit of of 6 months or $9,000.00 I too am facing the same thing almost as you, but as yet I have not gotten a letter. What happened was I was out sick with achilies tendonitis, when I tried to go back to work they had a letter from the QME saying I could no longer work based on injuries from 1992 from old doctors reports. Since I am in a unnion I have 1 year to fight or I will be severed(new word for fired). In my case as most people know on here I stand to loose alot of money if i leave berfore Oct. of next year. So I have decided If I can't get into the dept they have for injured operators(have to pass some crazy test) I can either take a medical and still loose alot of money and some options or I can remain out sick until my time (23 years) with the company is up and retire. The second option is kind of risky because first I will not have any medical ins. from the job second They could deny my extention and fire me anyway. If your surgeon says you need surgery you should really do as others suggest and look into it so they won't have an excuse of you were offered a sollution and you refused, but they can't force you to have surgery. You really need to do as newdriver said and sit down and look at your whole situation and decide for yourself what is best for you. Also check out all the sites 1171 offered. good luck
