restrictions come from a physician not an insurance carrier.
you should discuss you limitations with your doctor; they will decide if they need to be changed. if you are temporarily disabled from the aggravation, you can't collect unemployment as you have to be able to work. if doctor takes you off work, then you are eligible for temporary disability payments from the new injury. yes, you can contact the carrier directly and update them on your situation. |

I was layed off.. I went to dr again. he listed restriction as no use of R. arm for repetitive work. I/C contacted me. I told them what dr said, told them about layoff. Next day I received call from diff I/C person. I was approved for medical only since I really did not miss any work. I had applied for UC since I understood you could qualify for UC until approved for WC. I/C said that if I was "fit" to work then I should get UC. This does not sound correct. Is I/c trying to avoid having compensate? Any thoughts? d |

If you are able to work, but unable to perform your time of injury job, you may be entitled to both UC and WC wage loss benefits. The problem is that WC would take a credit for every dollar received from UC. I would strongly suggest that you talk to a lawyer since I would agree that WC appears to be attempting to avoid payment of wage loss by sending you to UC.
