New York computation of schedule loss
Received info from my orthopedist, seeing comp insurance doc in a couple of weeks. My doc says I have retained a 40% loss of use from shoulder surgery last September (which I agree is accurate). No problems with employer then or now, do not have an attorney. I understand we will see what insurance doc has to say then work it out. (Not expecting major discrepancy between the two).
My question at this time is: how is the final calculation made to determine my settlement amount once a percentage is reached? I have found a schedule on the NY State website (using # of weeks according to percentage ranges), and have also found a Schedule II (which seems to result in similar, but slightly higher amounts). Which one would be correct? Neither is clear as far as a date or qualification of use. HELP! Thanks.[/font]

A quick update... Just got a copy of the statement from the Comp doc. He totally agreed with my orthopedist that I have 40% schedular loss of use of my arm. Just waiting to hear from Wrkrs Comp now for a final hearing date to get this resolved once and for all. Thanks again for the link to calculate the amount -- it is immensely helpful! Smile
