I am from Ohio. I went to a workers comp dr..they gave me a rating for 9% on a shoulder injury. My lawyer than appealed that..sent me to another dr. I just got that back at 29%. When they were figureing up my amount at the 9%...they did it this way. 9%= 66 2/3 of my aww X 18 weeks. I saw the part under ohio bwc and saw where a shoulder injury is like 250 weeks..but not sure why that wasn't used. I just go along with what my lawyer says...I don't understand any of it.

gaculi I am in Ohio aslo, the OH BWC does take the percentage number and doubles it to come up with number of weeks, then they do multiply it by 66 2/3 of theaverage weekly wage. you are correct as i have received 3 different payments and all were done like thatl

Now that you have 2 different ratings, and there is a large difference your attorney will go before the industrial commision, and they will determine the actual percentage to pay you, you will not have to be present that day as they will only be going over the numbers and the alj judge will be the one to determine the final percent as a whole body.

You are right..I got my letter today for a hearing. It does say I have to be there though. They will probably go up to 10% lol.
Oh wanted to ask you...Why did you receive 3 payments like that..if you don't mind me asking?

I hope it all works out for you, your attorney will try to get you the largest percentage that he can get, as the higher the number the more money he will earn.
