Need Advice

Hey, there everyone. I was injured on June 4th and have filed a claim on June 8th. I was a driver for FedEx and hurt my back lifting heavy boxes. I Have a ruptured disk, that is pressing on my sciatic nerve. I have had an MRI done to verify this. I have been jerked around by the insurance company for a month and a half now, and they just told me a week ago that they denied my claim, but they wouldn't give me an explination as to why, or how I could appeal this. They just told me that it was determined that it wasn't work related, and I asked the guy how they figured that, and all he would say was that he couldn't counsel me on that. So I have went to my local office, and have talked to them, and I told them the day it was denied everything that was said to me by the insurance company. They said they would call me back. I waited a week and have never heard anything. i went down there yesterday, and all they did was try to call the guy, and siad they couldn't do anything till they heard from him. Do I need to go ahead and talk to a lawyer? Also they sent a piece of mail saying that my employer and/or insurance had to send a panel of doctor's for me to see, and was required by law. I have never recieved anything from either one. Could that be a violation of my workers rights? Any headway would help Thanks. Sorry so long. Dbusic77-Tennessee

sounds like you need a benefit review conference.

they are required to file a C-23 (denial notice)

you may also need to litigate the case. to find an atty try here

with a work comp denial you can get treatment from your health insurance and they will file for reimbursement from comp carrier once case is decided.

You are better off going ahead and getting an attorney based on my experience. I didn't want my case to get that involved I just wanted to get better and go back to work, but after 4 months of not working, no payment from comp, and doctors refusing to see me because my insurance would deny the appointment based on it being work related I had to. Did some research to find that best attorney I could, met with and hired him and he called me the next day with a doctors appointment and a check for 4 months of backpay.
