Worked for employer in New York State for approx 10 years, which was the original cause of the condition. Now working in the state of Virginia for another employer, and condition has deteriated to the point of surgical intervention to correct. Would anyone know my chances of filing compensation claim againt the original employer? I worked for the NYS employer from 1991 to 2001?

time limit for filing a claim (form C-3) under New York work comp law is within two years of accident, or within two years after employee knew or should have known that injury or illness was related to employment.

aggravations are considered new injuries. you should file under your current employment.
