Any Way To Audit My Attorney??
Morning/Afternoon All,
I know there is a form to have my payments audited via "the system" here in CA; is there a formal way in the WC system for me to have my Attorney audited to see if he has been working in my best interest? Or is that the basic "good luck with that" and I have to find another firm to look into the Attorney I now have? A quick update as to why I ask - 2 days before my 1 year anniversary of filing (7/27/10), the IC authorized surgery and said they would reinstate my TTD benefits upon scheduling my surgery. Okay, fine. I picked my surgeon from the list, gave the name to my Attorney and said please make my appointment ( I tried, but the Dr's. office would not deal with me) for me - that was on 7/28 last week. I just called the paralegal again now and I get the same response I have been getting since last Friday, 29th, "nothing yet we are waiting to hear". "What's the hold up?" "I don't know, maybe the IC, maybe the Dr's office" On the bright side I have a meeting with my Attorney tomorrow and if there is a legal way for me to have them audited as to their representation of me, then I want that card in my pocket when I talk to him... I'm a little confused as to what exactly you are asking. You can request a "benefits paid" printout from your I/C, but since you are repped, I believe your attorney has to request the printout on your behalf. The regulation is T8CCr Section 10607.
http://www.dir.ca.gov/t8/10607.html Also, I do believe that your surgery appt. needs to be requested by your PTP or your I/C. Whenever I've had a surgery or a procedure that has been approved (or not) the request goes to I/C by PTP request with a copy to attorney. The request then goes to UR and is answered in writing by UR to PTP, IW, and Attorney. Once authorization was received, I've always been able to make my own appts. for medical by referring to UR letter of authorization. If the request was denied by UR, then my attorney writes a letter to PTP and it starts all over. The maze is a circle of love. LOL! Hope that helps a little. Take care. Let Go, and Let God...... |

no, there is no external atty performance audit that is similar to a DWC claim audit. The DWC has no jurisdiction over atty licensing and practice.
Filing a complaint with the state bar for a violation of the code of conduct is the administrative remedy and, of course, you can still file a malpractice suit. |
