what can the insurance company do to dispute a supplemental QME REPORT?.
(California resident )What can The Insurance Company do to dispute a supplemental QME report?.
I went twice to The QME I guess the defense Attorney didn't like THE FIRST OR THE SECOND QME's Reports - After the Deposition the deffense Attorney requested for a supplemental QME report - I received the 3rd report 2 days ago and the report says that he sees no reason to change his opinions in this matter. My question is: What can the insurance company do to dispute a supplemental QME REPORT? |

send you to another Dr or accept it...2 choices...

california won't allow another doc.
not too many options but depends on their argument. if they believe it's flawed or based on unsound reasoning or incorrect legal principals, faulty history or testing etc. they can ask the comp court to throw it out or have it replaced. they could also depose the doctor; before going to court. more info here http://www.dir.ca.gov/dwc/medicalUnit/faqIW.html http://www.dir.ca.gov/dwc/MedicalUnit/QME_page.html |

Not much really, depose PQME and if nothing comes out of depo - petition to the WCAB to stricken report as insubstantial medical evidence
