What are the RIGHTS, if injured being already on Working Compensation?
Hi,

My husband was on working compensation for 9 months, after car accident in a rear at his job.
About a months ago, me and him had another car accident in a rear, unfortunately "hit and run".

Thank God, I am absolutely fine, but he got another back injury from the second car accident.

So now the question, how is it going to affect his working compensation treatments and what to do?

Was his WC case closed or is it still on going? This is just a guess but if he is claiming new injuries from this accident then it's going to be up to the doctors and lawyer to decide. My bet is WC is going to claim this new accident caused new injuries and not want to pay any more. Is he off work now from the first injury? Has this accident caused new injuries?

Well...WC is going right now, he is off work on WC, the last accident cause some troubles with his lower back. The doctor said basically they are not responsible for anything off duties, so they don't care....

If the injuries are to different parts, then it shouldn't effect the treatment for the original injury. For example, if the original injury was to his neck and the new one is to his lower back, WC should continue to treat the neck, however, they will not treat the lower back.

If however, his original injury was to his low back and now it's reinjured or worse, they may stop benefits on the grounds of that the new injury is the reason for continued treatment.

Also, please post your state (unless you did and I missed it) as different states treat these things differently.
