[font=Arial][/font]Hi there..I am new to this page so bare with me. I am in California(L.A) I am the IW with attorney. I worked for a very well known medical center in L.A(lots of celebrities)I am going to make my history as short as possible. First injury occurred in 3/08 with a Peroneal Tendon Subluxation an diagnosed and treated a as a simple ankle sprain. Went back to work with restrictions(was using a cane at the time)on 1/10 and then suffered a second injury on 2/10(slip and fall). Injured my lower back and neck which resulted in two herniated disc's L4,L5,S1 even though was only treated for back pain. Claim one was originally accepted until almost a year later I finally had an MRI and a doctor from the hospital who was not my PTP indicated I should had been P&S and misdiagnosed as an ankle sprain so IC stopped all TDP and asked retroactive. Second injury was a denied claim almost from the get go. Interesting enough, when went back to work after first injury, my immediate supervisors made my life a living hell. Reason I got re-injured was because the nature of my position was very much ambulating through out medical center,lots of standing and walking so they forced me to go out on the pouring rain, I was literally walking with a bad ankle assisted with a cane,a folder and an umbrella. Went out, slipped,lost balance and felt ON THE WET PAVEMENT!!!
My biggest mistake was not to hire an attorney form the beginning, I thought I was being well taken care by our own MPN, had a personal Nurse manager assigned(a spy I learned).Funny enough I was never getting better but actually worst from the pain. Got PT that made things worst since they all treated it as a simple ankle sprain. I switched doctors within MPN three times trying to find out the source of the pain, went to pain management ,acupuncture...nothing worked until I demanded an MRI. That's when a non treating Dr. said I was P&S...then I resourced to one final Dr. and he was able to diagnose the Peroneal Sublaxation but by then the IC had sent me to a QME (even though I objected)that ignored TP's diagnose and went along with the Ankle Sprain. That's when I realized I had been taken for a ride so finally got a last minute attorney which I regret up to this date because it was one of those advertised on TV(Larry H Parker). hey hooked me up with an apprentice at some shady practice with shady doctors, they filed my case in another city(Long beach)and never got my benefits back. While all this was happening I got injured again and decided to switch attorneys so they would take the two claims.
Long story short...my new attorney has done nothing to get me any benefits paid retroactive for ankle not the low back injury. I have not been working ever since so I have had no income for last year. I lost my place,my car was repossessed, credit cards debt stacked up, sue in court by creditors. I have asked attorney to file for Expedited hearing claiming hardships and still waiting. We go back and forth with IC...so far they have got away with all their dirty tricks(TriStar Risk Management) Recently I manged to get surgery through private insurance for my back because i had developed sciatica and was barely able to ambulate. My life has been degraded to the lowest point. I am tired of sending my current attorney requests...they never answer. I have learned more from the internet that from him.Recently there was a Status Conference and they send their hearing Rep vs IC attorney's..???? Now they want me to go to an AME when there were two QME's report for my back injury that adjudicate injury as work related. I heard that AME just screw up things even more.
I don't know what else to do at this point ... I want to move on but cant even work yet. I have told my attorney I would settle both cases for $40k taking into consideration of all the factors involved but I am not even sure he is listening...HELP!!!

This is the scary part of attorneys I keep looking and I am not sure where to go. When I see reviews of attoneys it is not about workman's comp. I don't want to be where you are. I will definately put you in my prayers and everyone here that is in this fighting nightmare called workman's comp. The only people that can make out with this is the people that are not as injured because they have the physical and mental(because of pain medication and everything else we're put through) to fight like crazy.

when you hire a WC lawyer you ask around your union,friends,anyone who has had one....you get one who has been a WC lawyer for years because they need experience and you dont wanna be their first....then talk to several and dont sign that day go home and sleep on it.....ask questions...how fast are you going to get back to me to answer a guestion....will I be dealing with you or your paraleagal?....and if I dont get on with your paralegal? I really liked my lawyer and his staff except his paralegal she was a witch and I didnt want to ever deal with her after the first 3 or 4 times I had a sit down with my lawyer and I never had to deal with her again....sometimes 2 people just dont mix.it You have to remember they work for you....but you are not their only client.....
