dr ordered a fce
At my appointment, my primary recieved the records from surgeon. In the surgeon's notes, he states putting surgery off until fall or if i request it sooner because of pain worsening.. I asked my dr to give me perm restrictions without having the surgery.. Unfortunately he said he cant do it without an fce first.. Fce was ordered at the local Y and they called today to set up test.. Once they found out the wc ins has denied all treatment, they say my private ins through the state will not cover it. They want $750 before the appointment or they wont do it....

Well that leaves me in a pickle, now what to do.....?
Lawyer hasnt returned my calls, ( he is probably busy ) they gave me the number for the local dvr and see if they can help out. But i wont until I confirm with lawyer first........

Guess I am a little confused about the purpose of the fce as I did not have one.

The IME doctor my attorney sent met to did a rating which ended up being 85%.
My attorney then sent to me a vocational counslor/job placement specialist who looked at my ability to work.

The counslor combined the IME rating (task loss) of 85% + the (wage loss) of 100% and came up with a rating o 92.5%.
He said the following in his report, "You have an individual limited to sedentary lifting with the need to change positions as needed for comfort. She also has right handed grasping limited to an occasional basis. All of these restrictions combine her imcapable of competing for work in the open labor market"

The lawyers Aid just returned my calls, amazing being after hours.. He said not to contact the dvr, he doesnt believe my attorney will be back untill a few days (trial out of town).. He is contacting him in the morning and will call back to see how I am to procede.. The aid feels there was some lack of communication between the dr and myself.. He feels the dr is seeking out to determine what kind of jobs I can do, when all were asking for is a rating and perm restrictions as the condition I am in now.. Wc is not involved in the loop since they denied everything, so why would he want an fce,? when he could just send me to an ime like they did on my hip.... Whats your take on this...???


1171, the $750.00 was just the down payment not the total... They said I could make payments on the rest... I signed a medical lien release between my attorney and the hospital and medi-caid right after I was injured.. The hospital and this YMCA is all part of each other. I mentioned this and all they said was they wont even try to run it through the state ins because they never heard of such a thing. I explained that this lien was placed from the state ins stating any money from settlement would be taken until debt of unpaid bills were paid....

Bummer, I have no clue why he ordered the fce.. I am baffled by his thinking, when all I was asking him was is the restrictions he has me on now permanent.. And if so, I asked if he would give me a rating and make restrictions perm.. I dont know if the reason is because he has me at restrictions that my employer will not accept. Or because he knows I will never be able to return to this job or any job...

I clearly dont understand what his intentions are.....

His intentions seem to hinge on the outcome of a FCE. Not agreeing but that is the skinny of what the Doctor wants. You will be rated with the FCE and I am guessing he has faith in the FCE being the answer for your Restrictions.

Bronco my Dr had me do a FCE test. He said he wanted to have it done so he could seee what my limits were. But then my employer at that time go a hold of it, and they used it as there little threating tool in my face. But my restrictions were taken from the FCE. That was before my lumbar was injured and before my 2nd cervical surgrey was done. I bet my limits today would be awful from that test.

Cervical Fusion 2003, c5-c6. Herniated and damaged Disc L1- L4-L5 S1. Lumbar Spinal Cord stimulator implant 09-2008. Cervical ACDF revision with hardware c4-c5-c6-c7 Sept 2009.
SSDI approved 3-2010. NOW OFFICIALY RETIRED
