Texas Workers Comp Question
I have been on workers comp from 12/2/2010. As all this is new to me and i have read lots of threads but still not sure how all this works.
1. My Doctor has told me my life\job has changed as i know it as i will not be able to do what i did. He has told me i will be a desk jockey. Will not be able to stand for more that an hour or two. As i was an working manager and now will be just a desk jockey. what happens if they do not have a postion for me when i do get released to just a 4 hour day to start and i am not sure if they will have an 4 hour day for me. I will start with 4 hour days but my doctor has told me that at that time i still will not be fully released as far as my MMI is concerned not sure what that means.

2. What happens when I do reach my MMI?

3. Will workers comp all way take care of me as i will have to have custom shoe mde for my foot for the rest of my life. Will they pay for any more surgerys that might be needed when i return back to work full time if i have still have a job to go back to.

4. Once i do reach my mmi is there any type of settlment on my foot as i will only get back maybe 50% use of it and it will all ways be twice the size of my other foot and give my problems for the rest of my life.

5. Should i look into SS disablity?

6. I have not involved a laywer as my CM has been great. I do realize she works for the insurance company but has not refused anything I have asked for and has let me pick out all my doctors and hospitals i have wanted. I really dont want to lose 25% of my workers comp check to a laywer if it is not needed any thoughts on this?

you need to be getting information about Texas workers comp.
if your restrictions are temporary and you can't return to work
wage replacement benefits will be paid.
they will stop when your restrictions are permanent i.e. reach MMI.
there are additional disability benefits depending on how disabled you are.

1) The IC will pay the offset up to 70% of your pre-injury wages.

2),3) and 4). Once you reach MMI. whether it be by medical oppinion or state statue. You receive an impairment rating. For each percentage point, you will receive three weeks monitary benifits. 70% of your TIBS. In Texas, under WC, medical for the injury is for life.

5) Thats your call. If you can not work and will not be able to work for a year. I would. The road to SSDI can be a long or short one.

6) If everything is going well, I see no reason for a lawyer. Most cases don't need one.

1171, is correct. Time to read up on Texas WC. It is a big state and different from most when it come to WC.
