When I say Illinois and the IWCC has an ongoing conspiracy I mean EXACTLY that..........Fits like a glove. I had a fine trial lawyer tell me the State of Illinois is immune from tort. The man is assuming they are doing their lawful duty...........WRONG!......They are not working within the law as you cannot use legal means for an illegal result.
This is more like a beating by the police.

Civil Conspiracy!...Legal Terms..........The elements of an action for civil conspiracy are the formation and operation of the conspiracy and damage resulting to the plaintiff from an act or acts done in furtherance of the common design. In such an action the major significance of the conspiracy lies in the fact that it renders each participant in the wrongful act responsible as a joint tortfeasor for all damages ensuing from the wrong, irrespective of whether or not he was a direct actor and regardless of the degree of activity.
A civil conspiracy, however atrocious, does not per se give rise to a cause of action unless a civil wrong has been committed resulting in damage. A bare agreement among two or more persons to harm a third person cannot injure the latter unless and until acts are actually performed pursuant to the agreement. By its nature tort liability arising from a conspiracy presupposes that the coconspirator is legally capable of committing the tort. i.e. he or she owes a duty to plaintiff recognized by law and is potentially subject to liability for breach of that duty.
Now what do you think happens when the state keeps you from accessing 19b-1 motion and your attorney doesn't file it or try to file it.
Your going to litigate and litigate more...........your not going to get your attorney fees paid except out of your pocket, your going to pay all the expenses i.e. filing fee's, depositions, doctor reports, etc ALL coming out of your 2/3 check. Your credit is going down the tubes, your going to be desperate and worry yourself sick all done without a State of Illinois safety net....i.e. to collect unemployment

Your attorney files for 19k (penalties) and section 16 (your lawyer fees) but he doesn't care if you get it or not..he will get his fee out of YOUR CHECK regardless what the court does.

Your Civil Rights have been trashed.

And the Commission panel is made of three people..........one for the state one for employers and one for LABOR.........they are from the same cut of crooks so if you think labor is going to watch your back.........forget it. They are most likely from the same lawfirms that do this everyday.THE BROTHERHOOD............SICK!

I do believe we will be getting some help soon. Below is the latest from the reporter.

Just spoke to state Sen. Kirk Dillard, and it sounds like momentum is gaining quickly for some type of major IWCC system overhaul. Here's a quote from Dillard that's gonna be in the story.

"There has to be a way to get legitimately injured workers' cases heard quicker ... and make sure they receive a larger percentage of their money, and not their lawyers."

Also, Kyle McCarter, a state senator from Decatur, is also very animated about this topic and all of the fraud that's going on at the workers/taxpayers expense.

Things are chugging along on my end. Won't be much longer now till the s&%$&# hits the fan.

I have told Senator Garrett that if I have to I will sent the sitting Governor a subpoena along with every other lawmaker in the State. No Lawyer I know of would think of doing something like that. So when you educate yourself to the rules of Civil Procedure and the law you can really open some eye's.

The FYR of the Commission talks about what a great job their doing. Nonsense!
You may get a fairly quick emergency hearing but that arbitrator can order anything he wants it doesn' t make a damn bit of difference if the insurance carrier and their lawyers don't want to pay. Your not going to get what is due you under the law until your starved and there are no more appeals possible.

I do have have an objection to the Statute in that I believe it is UNCONSTITUTIONAL............Why...........it does not give equal treatment under the law..........State workers are not allowed to go to the circuit ct, appellate or the Supreme Ct. Quite an advantage. Who the heck wants to litigate for (limited damage unless its a third party suit) 2/3 of your check and the right to be cut on............with you getting stuck with the bill.

The reason State Workers are automatically expedited through the SYSTEM is the State of Illinois is the largest employer and they simply don't want a State of Illinois worker to sit on his or her butt for years DOING NOTHING knowing full well that eventually they will have to pay, absence any fraud.

Insurance carriers ALWAYS love to talk about fraud...........the facts are and reality IS a non issue. i.e.........Since 2005 I believe the State and Mr. Walsh (fraud division) have 14 or so convictions through the States Atty office, and three or four of them were Insurance Agents not sending in the premiums they collected for workers comp coverage to the parent company. COME ON!

I do believe the State has to either treat state workers like the rest of us or we get treated like state workers..............and I do believe a Federal Judge would agree.........Equal treatment, ..... not discrimination just because you don't work for the State or a specific employer...........PLUS I do believe a Federal Judge would go balistic looking at how the State of Illinois and specifically the IWCC has been preventing your ABSOLUTE Constitutional right to access the 19b-1 motion or simply put .....the law.

I have given up on finding a lawyer with guts and integrity to litigate in federal court. You do need a lawyer for the class action. I am not one.
The facts and figures don't lie. I may be a rather messy litigator but I do get the truth of fact and apply it to the law.

I will soon sue my own former attorney as I simply don't trust another to do it.......I will remind all of the petitioners............lawyers work for you, and cannot quit unless they get leave from the court with a withdrawal petition. It is YOUR case not his...........and ask questions...........and don't trust them for a second.

Lets see what happens when more of this is PUBLISHED.
